Whiskers Speeding Ticket Thread

On the way to AC with my friends in the car going 73 in a 55. I think I was going maybe 65.....Anyways, got the ticket and thinking about getting a lawyer...

Where did you get the ticket? NJ or PA? if out of state and you have a PA license, check with your local DMV, the points may not transfer over. I know a NY license holder does not get points transferred over from speeding violations anywhere in the US. If they don't transfer over, suck it up, pay the bill, and be more careful next time..

Some NJ state troopers are Nazis. With all the toll roads and the SS patrolling it makes me never want to drive to AC whenever I'm in Philly.

that sucks.

Here in ON the radar cops tend to give you the ticket, then offer a court date to reduce the ticket so no points appear on your record. I guess nothing like that happens in NJ?

You plan on challenging the ticket? Even with a lawyer isn't it going to be tough if they have proof of your speeding (i.e. the radar/laser)?

I would call them to confirm..The page generally is discussing a "Commercial Driver". I'm not sure if PA is labeling everyone as a commercial driver or people that drive trucks to being "Commercial"..

I plan to call DMV, my insuance and a lawyer tomorrow..It sucks, but at least I won in AC...

It doesn't? In CA, the radar guns have to be calibrated and sometimes they aren't. You can ask for verification if this heads to court. It's a decent defense especially if Whiskers is under the assumption he was going maybe 10 over.

I've never seen the "gun calibration" excuse work. Not that I have a whole lot of experience, but I know a LOT of cops in NY, and have had discussions with them as well as other drivers about it. Even if he fought it and didn't have a lawyer, they have district attorneys and prosecutors involved to plea bargain it before it even gets to the judge. That is info based on the one and only time I ever had to fight a NJ ticket (before I knew the points don't transfer).

My NJ story was a good 10 years ago driving in the Newark airport terminals. It was misty/raining/foggy. The left lane was a designated "No Stopping" lane. This car in front of me (I'll never forget that f-ing Volvo S80) kept slowing down and stopping to drop off the passengers in the car to their terminal. At some point in that lane, the car stops and everyone gets out to unload. The lane to the right of them was completely clear and was one of the assigned unloading lanes. Once the passengers all got out, the driver sat there waiting for them to go into the terminal. So I signalled, changed lanes and passed (on the right) to keep going.
About 2/10ths up the road a cop walks into the middle of the street and tells me to pull over. I asked him for what, he just kept telling me to pull over. He tells me I committed an unsafe lane change, reckless driving, and gave me a ticket for no registration (I had the reg, but it was a photo copy, which is allowed in NY to have, but in NJ it must be an original reg document). I asked how the cop managed to see all this in the misty/foggy weather and from so far ahead, he ignored my question. I asked him why the car in front of me stopped, he said that there was a car in front of it, which I said there was none. That's when he said "if you want to argue with me, save it for court", and I said "no problem!". It's one thing when you try to fight something you know you're guilty of doing, it's another when you know you did nothing wrong but are still getting charged for it.
When fighting it, I spent HOURS in court waiting for this A-hole to get there and he never showed up, normally you get dismissed, but in NJ, nope, you wait for him to come. We rescheduled, and I didn't show up (My worthless lawyer rescheduled). This went back and forth for over a year. Then the day we were both there, my lawyer tried to shmooz the cop with little success. I showed my original registration document to him to show I had it. They dismissed the reckless driving charge and still charged me the lane change and no reg violation (even though I showed it, the cop wanted the court to collect the $$ for the fine). Long story short, I paid the fine, was "charged the points" and moved on. I found out that the points don't transfer over from NJ to NY while fighting this ticket, so I didn't care what the verdict was.

And even though I was charged with points, it never transferred to my license.

I have a similar situation. Was laser clocked at 101 on ACXway at 10pm. Court date is 9/28 in Hammonton Municipal Court. I did hire a local attorney and I can only pray that they reduce the charge and take the money. If convicted at this speed it's a mandatory 90 day PA suspension and yes, for any violation over 14mph in excess of the posted limit they do report the violation to PA. Don't let anyone tell you it won't get reported because it does.

get it knocked down if you can. I will assume it was ont he AC expressway. You can really lose track of time and speed on it esp if yapping away there.

Knock on wood, I've been very lucky for the last few years. Last speeding ticket I got was in a blatant speed trap, was coming around a blind curve on a freeway service drive where it went from 45 to 35.

I spoke with the cop at court before going in to see the magistrate and asked him to drop the infraction to "blockading" which is a non-moving violation (thus no points). Since I was cool and the cop was cool - paid the fine, his municipality still got paid, and was on my merry way. As long as you weren't a jerk when he pulled you over, maybe you can try this too.

I've done this in the past and it does work. However, its never guaranteed that the officer won't show because, from what I know, they still have to contact the officer that issued you the ticket with the new court date, just hope that it isn't his day off on the new date.

When it comes to getting speeding tickets, I say, pay the fine and just take traffic school on the net and call it a day.

If you already have points on your record then no, but if you don't have any points on your record to begin with and you haven't used traffic school within 18 months (?) the traffic school will prevent any points from going on your record. Its the same as if you were to physically attend a class, traffic school on the net is really a joke because its so much easier. Good luck!

Usually you'll receive a letter in the mail that gives you a list of traffic schools to take online and a date that it will need to be completed by. Once you finish the course online you will have to mail in a certificate proving that you finished and that's it. The earlier you get it done the better IMO.

The last time I had to use traffic school online I couldn't believe how easy it was, none of the information even pertained to driving a car. What I had to do was read these pages and at the end of each page I had to answer a question about what I just read. The question at the end of each page asked me what political figure was mentioned during the essay. Each answer was a different member of the Bush Administration, so after the first page, I just perused through each page looking for a member of Dubya's Admin, super easy, super dumb and super quick to finish.

If you got written up for 73 in a 55 YOU ABSOLUTELY need to fight it.
Anything 14 miles or over will transfer points. Spoke to a friend that is a Jersey State Trooper and that's what he told me. This guy knew what he was doing when he wrote you up at that speed.

I know its 2 points. I can either fight it or do the traffic school thing. The traffic school thing is cheaper it seems.

if you have a relatively clean record, you can plead it down to something lower w/o a lawyer. You are out the money for the ticket, cost of gas/tolls to go to court and a few hours of your time.

So you schedule the court date then? Sounds like this is the best option for me since I don't work and wont need to miss work...I guess the plan today would be to call the court and schedule the court date. Hope the cop doesn't show up and if he does, try to plead it down without points...? I haven't got a ticket in many, many years.

I guess then if it doesn't work, I can do the online traffic school thing.

DO NOT CALL YOUR INSURANCE!!! you do not want them knowing you got a ticket!!!!

A lot of times things don't transfer over, or take forever to. Dumbest thing you could do is call your insurance company and say "HEY, I GOT A SPEEDING TICKET"

every state is different. Even in Cali i've gotten around the 18month statue....basically tell the judge you will fight it, or plead guilty with correction of traffic school. 90% of the time, they'll let you do traffic school again within the 18months


Also, Online School is up to the county. Some jurisdictions will let you do it online, some require sitting in a room.

Called the court and pleaded not guilty, they told me the 0-14 MPH is 2 points and 14-30 is 4, so its 4 points. I'm scheduled for October 1st. I left a message for a lawyer too. I guess if I can get it down to 2 points, I can do the traffic school thing.

That's not bad at all... In CO 5-9 is 2 points, 10-14 is 3, 15-19 is 4, and 20-39 is 8 points. Colorado sucks!

Spoke to the lawyer, basically said that NJ points sometimes transfer to PA, but not always. He said that for $400 he can make it go away (the ticket itself is $100). I may just do it.
