Not sure how a company is going to let another company tell them what to pay. I suppose I can't speak for totaled cars, but that's not how it works otherwise.

This is how it works - if the damaged-party decides to have his own insurance company handle the claim (even though the other party was at fault) he/she will negotiate a settlement with his/her own insurance company. Once that is completed, his/her insurance company will turn around and subrogate against the at-fault party's insurance company and they will come to their own settlement between the two insurance companies. Essentially, that will involve the at-fault party's insurance company reviewing the settlement paid out by the damaged party's insurance company. If they would have paid the same amount, they cut that insurance company a check. If they wouldn't have paid the same amount, they will have settlement negotiations. If they can't settle, the damaged party's insurance company has the option to sue the at-fault party's insurance company.

Interesting. I have only ever dealt with the other guys when I wasn't at fault, but neither time was a total loss.

Let AAA do it-- it's the other driver's insurer, and AAA adjusters are usually pretty good (i.e. better than fair) from both professional and personal perspectives: in vehicle cases at work and as a policyholder.

If you're not satisfied with AAA's estimates, then get USAA involved.

Sorry about the car, but glad no one was hurt!

Car is now at co-part and should be appraised today. Judging by the pictures, I'd say it's totaled.

The good news is I have 0 neck pain and no side effects from the accident.

If the car totals out like I expect, I plan on getting another 7G Accord 6 speed or 3G TL 6 speed, really depends on what is in my area at my price range (~ $15,000)

Yep, I've been searching high and low.

Found an 07 NBP Accord 6 speed, 51k miles w/ with Navi for $14,400 in Las Vegas. I just need insurance to cut me a check and I'll be on my way.

If you go this route, does the damaged-party's rates go up?

I have USAA and would definitely would rather deal with them in this case.

I can't speak in absolutes, but it shouldn't. You get rate adjustments generally when it's your fault. Last time I was hit, I went through my insurance (State Farm) and let them subrogate against the other guy's carrier and I saw no increase at all.

I failed to mention in my previous description that if you go through your carrier you'll come out of pocket on your deductible at the outset but then you get it back after the your carrier recovers from the other guy. So, in my case, I was out of pocket $500 to get my car fixed at the beginning and then I got a check from State Farm for $500 a few months later when they recovered from the other guy's carrier.

Dude WTF that sucks but glad you walked away from it ok! You need to go see a witch doctor or something to get rid of this car curse lol. Good luck with your Accord/TL 6mt search. That NBP in Vegas sounds like a sweet deal!

Update: Insurance will be paying out $12,200 for my Altima (I originally paid just over 11K + taxes & registration)

When all is said and paid off, I should have $5000 down on my next car.

As much as I'd like a 335i with JB4, $15k price range has them at around 100,000 miles and I just can't just can't justify the insurance & potential repair costs for a used BMW. I've been spoiled with reliability with my Accord / SER and plan on keeping a worry free daily.

I'll post up whatever I purchase this weekend, I've narrowed it down to a paid off CL-S or financed TL / Accord 6 speed.

My first Cl-S 6 speed!

Cliffs:

- Clean title
- Interior is in great shape
- 127,000 miles w/ maintenance records (timing belt done)
- Original clutch - still grabs, no slipping .. car appears to have been babied.
- 1 door ding / 1 small scratch on the quarter panel
- No resprays
- No leaks
- Car tracks straight with no noises from the suspension


Only con: Broken 6 disk changer .

Car cost me $6200, no payments!

I'll post more pics when it's detailed.

I've driven the car about 200 miles today and it feels good, no issues to report.

Perhaps I'll make another "build thread" for the CL-S, coilovers & getting a spoiler-less trunk is on my to-do list .

I detailed the car this morning and took out some blemishes with some rubbing compound, car cleans up quite nice. Owner said the car needed an oil change and it only burned about .8 of a quart of oil at 5,000 miles, not too bad .. Lastly, I took off the front plate.
