Since this is practically BimmerZine already . . .
Hmm, well I think I'd rather have a car that started out as a 3 series rather than one that started out as a Cherokee. I mean, do you even think before you post your BS or does it just spring from your mind like mental diarrhea?
and M5 >> M3. Forget Mustang comparos, it hung with the F430
The vehicles are apples and oranges. Not everyone needs a jeep and not everyone needs a 3 series.
here's some new advice: your jeep is going to look VERY dated when the new ones start to hit the road. personally, i would be furious driving an older gen jeep, esp when it is ~20k more than a new base-level jeep that is better looking. that appearance reason alone would force me to trade. (maybe i love the new gen that much more)
...of course one can make the rebuttal that the SRT is in a class of its own, and that the new gen wouldnt cloud your judgment.
when do the new SRTs roll out? i would consider trading up as option #1.

There ain't no "free lunch" and there ain't no "free maintenance" neither.
I think free maintenance started many years ago. Either way i know the 2008 have it.
2008 has the old idrive and the pre-lci tailights for the Sedans. The new tailights came in the 09 models as well as the new Idrive which is vastly improved.
Stock shifter is long and nootchy, there tons of aftermarket short shifters to fix it and is a must. IMO
The new M3s have been faily reliable. No known issues that are wide spread. Some of the 08s had an idle valve issue which dealers fixed. Not something you can tell from driving it, a check engine light would be on if it needed replacing.
Just have a dealer run the service records on it and go from there.
Also take it for a long drive. M3 is special and you really need to rev it up to make it FEEL fast compared to your SRT8. SRT8 just has good amount of low end compared to the M3. They drive differently but i prefer the M3.
SilverstoneII on red leather is so yummy.

Yes, I have been ooogling the new one-plus it should be able to tow as well . . .
I have always liked M3's and this one is coming in at a great price. The Jeep is just about the most impractical SUV ever made (can't take it off-road, can;t tow anything with it) and that is why I love it
With that said, since I can't use the Jeep for what I should be able to use a SUV for, I have been thinking about getting back into a sedan . . .

Just choose what fits your needs.
And my vote goes toward the M3

If you say that, I think a lot of people can't respond to more than half the threads here
Let me get this straight, OP is debating between a tin can Jeep verses arguably the "ultimate driving machine". But wait there's more; people are actually trying to convince him to keep the Jeep.<?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" />

I'm going to blunt, you couldn't pay me to sit in a Jeep Cherokee even if it had the same engine of a Bugatti. It looks like Buddy Hackett in comparison to the drool worthy M3. $42K is a deal, and you might be able to talk them down a couple grand. In this economy, anything's possible. Do yourself a favor, and trade in that hunk of crap, and enter the lap of luxury with the performance to make a grown man, like myself, cry.

And you’re damn right I'm biased, since I'm looking to purchase an 09 M3 by next year spring.

Or the new Exporer.
Why would a guy with the above cars need an SRT8 Jeep?

Just sayin'
Holy crap-Jordan's alive! Where you been man?
And why would I need a SRT Jeep with everything else? Why not? I love cars and it's fun-all that matters.
On topic now, I went back to look at it yesterday. It is relatively clean, but has a good size ding on the passenger rear quarter and is missing a button to the left of the shifter. Speaking of which, the shifter has obviously been modified, and not in a very good way IMHO. Getting into second requires a deliberate two-stage effort: One to get it in line, and two to get it "clicked" into gear. It's not very easy at all. At this point I'm thinking of skipping. I have another appointment today to make a final decision.

I can see why that porky Jeep is annoying for anybody having fun-to-drive among top priorities, not talking about its K-mart fit & finish typical to Chrysler products of that era.
BMW and specially M-cars are in a totally different league.
However, E90 are not very practical vehicles if you are used to a SUV. And of course, it depends on the amount of money involved. If you have to eat 10K$, well think again.

An M3 certainly isn't the most practical car, but I don't think a 5000 lb. SUV with low-profile tires is the pinnacle of practicality either. I didn't realize that it was necessary for you to make a douchebag type of comment anytime someone disagrees with you or doesn't worship at the altar of Chrysler.
At first, I was going to say that you should get the M3.
But now, learning about your collection, and the issues (if that's what you want to call them) with this M3, I'd stick with the jeep. You've got a Ferrari, a Viper, and the one of the best Hondas ever built. You're not really hurting for fun-to-drive cars now are you? And by the looks of it, that's all you're really gaining by going from the Jeep to the M3.
I'd also be very suspicious of the problems with the M3 you're looking at. If the second gear shift thing is not normal, it could be a sign of a more serious (read: expensive) problem within the transmission. I'd stay away.
Best of luck with your decision.
