Selling/trading car under Chapter 13 bankruptcy

I have had my 2002 TL for about five years now. since then I have started a Chapter 13 bankruptcy which I've been on for a few years. the car went under the payment plan to pay off the bank. but I recently read that the transmission warranty issued for this generation ends at either 109,000 miles OR 7 1/2 years. whichever comes first.

now i think i want to get rid of this car beacuse I don't want the headache of having to pay to get another tranny should the time come. do any of you know what could be done in my situation as far as trading for another car whether it be of greater value or the equivalent? or if I can sell it without having to pay off the remainding balance to the bank(or does the balance remain under the Ch13)?

the expense of a new car is going to GREATLY to outweigh the expense of a new transmission SHOULD you need one. I'd try to pay off the car I have first. Any loan you would be able to get would have an extremely high interest rate. You need to pay back the people under your repayment plan. Build some credit and then get a new car.

This is probably something to discuss with a bankruptcy lawyer or an accountant and not a bunch of goofballs like us on an internet board

IMO, you're better off keeping the car you have, getting your house in order, and then working on getting a new car.

I agree. I don't think he's going to get a car as good as the TL for the cost of a TL transmission.

Talk to a lawyer. You usually can't sell assets while in bankruptcies. Makes judge and creditors very cranky.

You might try justanswers.com. You can ask a question for $20 or so to a bankruptcy lawyer. Lot cheaper than hiring one.

Plus....there is nothing wrong with the transmission at this point. So, there is no reason to think it will crap out. If it were me, I would cross that bridge if I need to.
