Got Rear Ended
I was sitting at a stop light today on my lunch break, there was an 03 Toyota Camry behind me, stopped, and then all of a sudden I jolted, looked in the mirror and the camry had hit me. I pulled off as did the driver of the camry and i asked her if she had been hit as well, I thought that since she had been stopped that she much have been pushed into me. This was not the case, she apparently saw the Green arrow change color and thought that it was time to go, unfortunately the straight lane still had a red light.
I was in my Lexus, a GX470 so there was not much cosmetic damage, just missing a rear tail reflector and the bumper is cracked. I think that its going to be no big deal, so I take it into the body shop after work, turns out that the accident threw off the alignment of the enire rear of the car, the door which opens to the side, not up does not open smoothly and when it is closed there is a huge gap, also the bumper no longer lines up with the surrounding panels, about a centimeter off. I spoke with the woman who was drivng the camry and asked her how she wanted to handle the claim, she replied, "CLAIM?!? I broke a damn light, you are claiming that?" I went on to tell her about the damage to the rear of the car and she stopped me and told me all about the damage to her car, new bumper, headlights grill etc... In the end I filed a police report and contacted her insurance company. Apparently this is not her first incident. The claims adjuster called me and told me to take it to a specific body shop to have the car fixed, but I informed him that I would be taking it to the Lexus certified body shop, which has done repairs on all of my cars when needed. He told me that my body shop is significantally more expensive than their reccomended one but I insisted that my car be fixed the way I want it.
He then told me that he would arrange for a rental when my car would be in the shop and insisted that I was out of my mind when I requested something comparable to a Lexus... He said that they normally arrange for a Cavalier or Malibu? Is it out of the question for me to request a comparable car for the one that the woman damaged? The way I see it is she hit it, they insure her, and now it is their job to get things back to normal... I hate working with insurance companies...

(which it took him 3 times he said he would come he didn't)(i sat home all 3 times waiting on him and "no show")because I have a lawn matience company i use the truck to tow the tractors/supplies around. I said I want a 4x4 pickup for a rental while the truck being fixed. at first the lady claim rep said "well we can't do that" I said "look ma'am i had a 4x4 Tundra that was fine before your policyholder hit me it is not my fault your policy holder hit me so. i use that truck for business. I can't afford any 'downtime.' so if you give me a malibu or sunfire or whatever car you give me I'll go to Budget or whoever it is rent a pickup WITH 4X4 and send you guys the bill. I said we can do it the easy way where you guys set it up or we can do it the hard way where I send you the bill. either way your paying it.
she started to pop off. I said NO, THAT'S THE FACTS. she said "well see what we can do but i doubt it." I said also that truck WILL HAVE 4X4 because my truck had 4x4." she tried to pop off again. I said look I gave you the options either way you guys are paying it. plain and simple. good bye and hung up. she was PISSED.
but yeah I see your point of deserving a nicer car than a Malipoop.
my main complaint about insurance companies are this: when you get a speeding ticket or wreck they sure want to nail you when you get your next bill. but when you file a claim they sure want to clam up with that money. I know their trying to save money but don't be retarded.
Yeah, i spoke with the adjuster again today and he still wants me to go to a body shop that does not use genuine Lexus parts, he said that there is no difference between a refurbished lexus bumper and a brand new one, my response was "yes there is, the fact that the bumper on my car was not refurbished, and that had your client not hit it I would never have to have one put on, also I drive a car made by lexus, not some refurbishing company." I get so PISSED at insurance companies, and this lady what a trip. I know that if I would have hit her her neck and back would hurt and she would try and claim every little scratch on her car, but noooo its the other way around and I am just supposed to forget about the incident and move on my happy way with a far that she fucked up?!?! I dont think so, not when I baby my cars like I do... Jesus what is wrong with people.

I'm getting ready to graduate with my undergrad degree in business administration. i've had I bet 5-6 insurance companies(mostly car, some life) call me saying how they want me to work for them. I just laugh because I feel Insurance people screw the good guy.
they just fix enough so it's street legal. they don't care if you have a Lexus, Benz,Maybach whatever. they fix it as cheap as you can.
BTW: stick to your guns on the deal with a Lexus certified shop. you don't have to take it to "their shop" they can get in trouble for pressureing you to take it to certain shops. I had a friend who got hit in his Benz. he told them he's only going to a Mercedes certified shop.(it was like an hour away to the closest Benz certified body shop) they said why don't you take it to Helman's body shop(it's a local do everyone's Ford,Chevy,Dodge,whatever anyone has body shop) he said no. they said fine we'll only pay what helman's would charge. well he sued the insurance company for the amount over helman's. then reported them to some insurance foundation(it's a group that makes sure basically the insurance company act "fairly"(Insurance and fairly that never goes together) i guess they got fined or got in trouble.

Man what a week, I basically told the adjuster that if his insurance company would not allow me to have my car fixed with the parts I want, at the shop that I want that I would involve legal counsel. I also told him that my rental car will seat no less than seven people and be comparable to my Lexus, I need 7 seats becasue I drive my kids carpool. The second I mentioned legal counsel he immediately became cooperative and I have an appointment to take my car in to my bodyshop on may 4th at which time a Linclon Navigator will be waiting for me.
I sure as hell hope my insurance company would not treat anyone I hit like this, I would be embarrassed to be affiliated with this womans company.

so i took it to the body shop i wanted. they paid the full amount.
they just like to play games with you so they don't have to pay as much.
I always love how when you have at fault wreck or speeding ticket. they want the cash NOW. but when it comes to paying out for a wreck you gotta about threaten them with legal action to get any money out of them.
