FML: speeding ticket

dang, I got a speeding ticket today. I got off lucky too though, I was going 120, empty freeway seriously only i was on it (surprising since it was only 7:45pm) then i hit the traffic and begin to slow down. inside that bundle of traffic was a highway patrol officer. I had decreased down to 75 already (speed limit 65) and he still pulled me over. he said "you're going over 100 there buddy" -- gave me a ticket and said "i only marked you for 90, so i'm letting you off easy."

SITUATION is -- i asked to see the speed gun/clock whatever, and he didn't clock me he just said "i caught up with you and my speedometer read 90 before i pulled you over." should i fight this ticket? or am i pushing my luck. because if i fight it AND i lose i don't get to take traffic school and i end up with a point with the DMV.

i know, i'm probably going to get the comments: damn 18 year olds and their speeding. i'm sorry! it was too tempting, ALL THAT ROAD TO MYSELF!

anyways, fight the ticket? (win=fine, and no point & lose=fine, and add 1 point without eligibility for traffic school) or don't fight the ticket? (hopefully go to court, get a lower fine, and request traffic school)

btw it's an infraction and it's my first citation.

Well if he was doing 90 to catch up to you, that would suggest you were going slower than that no?

Always go to court for a speeding ticket. Plead you were going between 70 and 75 and see what the officer says. An officer is trained to spot a speeding car with or without a device. He says you were speeding and should have wrote you for wreckless driving since he didn't know an exact speed, but it looks like he wrote you for 90 which is still wreckless. An officer does not have to show you the gun as there is no officer that locks the speed on his radar as the speed changes so fast.

I have been on an open road and pushed it up to 120 before. But it was just for a brief minute to get the rush of the speed. It was stupid, I know. But who really have not done that before.

Don't fight it. Pay the ticket and be happy that he didn't catch you doing 120...

....anyone else notice that its always 18 year olds trying to fight tickets for shit they know they did wrong.

You just admitted to going 120. Deal with it....plus im not sure I'd post ANYWHERE that I was doing double the limit and I want to get out of the ticket.

Just reminded me that I got a speeding ticket last Saturday.. It has been a long time since I got pulled over for a ticket.

I was late for my friend's graduation and had to speed up a bit. Cop caught me going over 95 mph, but he cut it to 75 mph for me after I told him about the graduation. (had flowers in my passenger seat)

I'm happy enough.

Judge will tell you "He is radar certified" meaning he doesn't need to clock you. He is trained by sight to tell speeds within 5 mph (I believe its 5 IIRC) before they ever give him a radar to use. But it doesnt hurt to try, go to court, try your luck, but you'll probably end up paying it.

PS Keep the need for speed on the track, I'm not suggesting that I have not gone 120 on the highway, but that was years ago, and I make a sincere effort to no longer do that stuff. Be careful! Those few seconds of glory are not worth a a possible lifetime of penalties. Oh, and I understand how you feel, I dont mean to speak as if I'm all wise and old, I'm only 21. Take it easy!

Either way you're fucked.... next time you get a speeding ticket, if you try to fight it in court they will bring up the previous ticket.

OP, go to court for the ticket and if ur record is clean theyll usually let you plea down. after that take a safety driving course to get rid of any points that are still left over

To the OP, you're an idiot and you got caught. Pay the damn ticket, go to traffic school if you get the option, and SLOW THE FUCK DOWN!!!

You're lucky that cop didn't arrest you for reckless driving and yes he could have. Whether you like to believe it or not, you're getting off easy.

I had a similar scenario happen. I sent you a PM. But instead he cited me for exceeding 100mph. I fought it and won. The ticket was written for somewhere around 875 Dollars.

Fighting tickets by mail is never a loss to you at all. Check your PM and you won't be dissapointed. Never go to court if you're under 25. Your side of the story vs. an officer at that point is meaningless in person.

Nobody's acting like they've never sped before, but most of them didn't come crying to a forum that they got pulled over. If you are unfairly pulled over and falsely accused of speeding or whatever, then by all means fight to the death but if you got caught fair and square, then deal with it!!! Most of us dealt with the consequences like ADULTS and learned their lessons. (Well most of us anyways).

Oh on a side note I forgot to add. Don't mail in your plea immediatly.. call the court and get a one month extension and then wait til the last week til you mail it out. Make sure you insure it.

This is a buffer to give the officer a little time to forget about the incident. And possibly lose any notes etc he may have had.

damn..

i knew i was going to get smashed on for speeding.
I'M SCARED AS EFF RIGHT NOW TO DRIVE ON THE FREEWAY ABOVE 65 LOL I'M NOT EVEN KIDDING. it's a lot slower to get to places -_-'' but dang, i know these things are expensive and i'm not down for another one.

hahahs I HOPE THE COP DOESN'T SEE THIS THREAD -- that'd be hilarious.

and just for the record, i'm not coming on the forums crying about my ticket. what's done is obviously done. and i just came on to see what others have to say about it -- you never know, might change something. i was just curious as to see whether i should fight this ticket or not, and i decided to ask for advice.

In order to catch up with you, he must go faster than you. If he was going 90, you had to be going less than 90 or he wouldn't have caught up.

If he's gonna use that in court he's an idiot.



And I doubt the cop is stupid enough to rely on that "method" of estimating speed alone.

Also if he talked to dispatch in any way relating speed when pulling you over, you are really screwed as he will provide the video and audio evidence.....

Do the crime? Do the time.

Pay the fine and learn from this experience. I was on an empty section of I-10 in West Texas yesterday and that particular section of road sports an 80 mph limit. I had the cruise set at 85 (by GPS, my speedo said 90) and every person who blew by me was pulled over somewhere ahead of me. I really wanted to peg the speedo but I didn't. It's not worth the risk anymore.

It may not be the "right" thing to do morally, but I say fight it. The argument that he was going 90 and caught up to you will not hold up in court.

You laugh but it's happened in other forums where some guy was ranting about the cop being a dick, etc. Then the cop, also a member of the same forum, responded with the true story and eventually used it against him in court. I don't think it's ever happened here but I don't know.

I never once said anything about "going to court".

And what the hell did I do to you? Because I got into a car accident I'm not allowed to give some advice to someone from first-hand experience?

I told the OP to do trial by mail. There's no point in going to court in his case. He's too young and will just get laughed at by the judge and the cop.

In case you didn't know just about every cop car out there has some video/audio recording ability and that stuff is activated as soon as they trip on the lights to go after him. Some other things recorded are the SPEED of said cop car as he is chasing your ass down.....

the BEST thing that the OP can do if he REALLY WANTS TO WIN is to go to court and plea down. Unless you live in some messed up state like CA, most DA will plea out just so they can avoid going to trial and will in MOST CASES offer you a larger fine/traffic school in return for a no points non moving violation.

non moving violation = big savings on ur insurance....

Do you even know what trial by mail is? The only reason officers go to court is because they get paid 2-300% overtime just for being there. If you send a trial by mail they recieve no amount of cash at all for replying. 1/3 officers never send in a counter argument.

Of course at some point all of us are guilty of going over the limit, (I have taken my car to it's top speed while being the only one on the road at 3am) so I won't bash you for it...


And at the same time, you really were guilty, but that doesn't mean you shouldn't try to fight it. I say fight it, and

BUT, I wouldn't fight it w/o a lawyer. Chances are you'll be wasting your time, because you don't know what to listen for in the testimony of the officer. A lawyer does.

haha, wow this is some pretty good advice no kiddin.

i spoke with one of my friends, who is a speed demon.
he fought and won a ticket for going 90 on a commercial 45 street.
arguement: it was safe to do so, because no one was around @ 2am.

this friend of mine fights every ticket, but he even told me not to fight this ticket. supposedly because highway is really enforced and CHP's are hardcore about their shit.
