Fab's MDX trashed.......

This past Saturday I was broad sided by a driver out of control. I'm waiting for my insurance company to hopefully TOTAL my 03 MDX which was not even a year old with only 11,500 miles.
JUST makes me sick. It was paid for, not a scratch or a dent, no car payments. Taken from me at the snap of a finger....
Anyone interested in the pictures, you will have to post them for me.

The camera illiminates "here say" it hard evidence to the insurance companies and my attorney !

He tried to make a right turn into the street we were sitting at waiting for the light to turn green. This guy tried to turn at 40 mph in a Lincoln town car. The pictures will answer your questions.

40mph in a town car, I do 60degree turns at 45mph, and then get followed by the cops the rest of my trip through town, but I do nothing wrong since it is a 45mph zone.

That sucks, but I doubt it is totaled.
The car is probably still worth 25+ and that doesn’t look like more then a few grand in damage.

You never know though. The frame could be screwed up worse then it looks.
How do the door gaps look on the other side?

Your way off ! My body shop said at least 15K with out "digging" in the vehicle (taking rear seats out and look at the structural part etc.....rather complicated). The vehicle is mint conditions with 11,500 miles is blue booked at $39,500.00, NOT 25K !

My attorney said we will know by this saturday if he has any further kneck injuries, because it takes about a week to show up. He has gone to his doctor and waiting for a MRI examination. I had to bring him to the ER for stitches and a tetnis shot (spelling). Remember this MDX weighs around 4,500 lbs. and was knocked 8-10 feet. That's no little impact, kneck and spinal injuries do happen later in the week......we hope not. I just WANT A NEW MDX ASAP ! I DON'T WANT THIS VEHICLE BACK AS EVERYONE HAS TOLD ME INCLUDING MY SERVICE MANAGER AT ACURA "IT WILL NOT BE THE SAME". There was transmission oil leaking in the front........

My goal is to AVOID a clusterfuck ! The idiot that hit us is now lying about the accident. What he doesn't recall is I HAD A CAMERA IN THE CAR AND HAVE TONS OF PICTURES THAT TELLS WHO'S TELLING THE TRUTH !!!! MY HAND IS DEEP IN HIS POCKET ! SO HELP ME GOD............................I'm just thrilled we weren't injured worse !

Sorry… I thought they were like 40K NEW and I was figuring 25-30 for one that had a years worth of mileage on it.
That’s even worse though because by your numbers they’ll definitely fix it even if it costs 20+.

there is definately gonna be some frame damage from that. You don't rip out the rear like that w/o damage.


A few grand to fix? The body work alone will be around 4-5K

sorry about your missfortune

But as you have stated, the blue book value of your car in $39.5K --> that means that you car needs to have repairs of over $29k (around 75% threshold) to declare it totaled (assuming there is no frame damage).

But don’t forget, if it DOES end up being totaled they don’t go by bluebook RETAIL.
You always have to fight tooth & nail to get what it’s really worth.
Maybe you’re better off fixing it in that case.

But none of us are experts here. We just pretend to be.

This is why I have hired an attorney. I told Allstate I WANT A NEW CAR ! They will collect from his insurance (STATE FARM). He is 100% at fault ! NOT ME ! Ever heard of "Diminished Value" ? That is what I may be sueing them for and I'LL SUE EVERYONE involved including my insurance company. HE HIT THE WRONG FOLKS ! MONEY ON MY END IS NOT A PROBLEM. I am single, no wifes or x-wives, no children and have pleanty of money for an attorney !

I just want a new MDX and to avoid a CLUSTERFUCK !

your beligerant ranting isnt going to get you anywhere with billion dollar insurance companies. dont you understand that they deal with people like you everysingle day? it doesnt matter if you are EXTRA pissed off or if you have a lawyer or if you DONT WANT your old mdx back, they are not in any way legally obligated to provide you with a new vehicle if the cost of fixing it is less than the cost of replacing it...its that simple dude. and if you really think your MDX is still worth 40k, then theres absolutely no way youll get a free, brand new MDX because that is definately not 40k or even 30k in damages. deminished value? sure...slightly, but again, if youre so sure its worth 40k in mint condition, even deminished value for having a repaired mdx will not bring it down into "totalled" territory. this is all simple math. you cant argue with mathematics as mathematics are never wrong.....ever.

I will agree with jimcol711. We all know it is fucked up what had happened to your car, and we are all happy the nothing happened to you. But just let the insurance companies do their work and just follow it. If you believe your car needs to be totaled then commincate accordingly.

You do not need to demonstrate you have the money; just tell us the reasons and that will be enough.

I hope everything is resolved to your side. and hopefully you get a new MDX. But keep calm, you are insured. Everything will work dude.

I agree numbers don't lie, however the guilty party is now LYING and this is whats bringing the anger out of me ! I usually don't VENT like this, but I'm not going to let this go by and continue to be "the nice guy". When I catch someone lying, IT'S ON........................
