CAR WRONGFULLY REPOSSESSED? sorry for the long post without paragraphs

CAR WRONGFULLY REPOSSESSED? sorry for the long post without paragraphs

So i went to work as usual and just before quittin time i walked out to my car...and i came inches from crying, as i look at absolutley nothing in my parking space. i stuble inside thinking that my car has been stolen i get on the phone and call the police to inform them that my car has been stolen. when the dispatcher was very friendly when she said that my car had been tagged for repossesion. But the only thing is, is that my car has never been financed through a bank my parents paid cash for it brand new, and i had always made my payments for the car to them. by this time i swear i could feel my skin on fire i was soo made that in essence someone had still stolen my car. so i call the bank that had my car "tagged" and i started out very calm...then when they told me i would be without my car for up to 10 business days while they verified that it was in fact MY car!!! I asked if they verified the V.I.N. before towing my car...they said the tow truck company could not see the number on the dash (i keep it covered) so they went off of the one on the driver's side window. So meanwhile im on the phone screaming my head off about how incompetent they are and how if this is how they ran business that others needed to know and how i was going to be the one to inform them. After about three hours on the phone and probably stroke level blood pressure we figure out that my car was towed by mistake because the V.I.N. that was on the window was from another car that i bought about 6 months ago from a guy parting out his wrecked TL so i thought nothing of it. Well it turns out that his car was going to be repossessed so he wrecked it. So i throw a huge fit and threaten to sue, thats when they decide that if i can produce the title than i can have the car back. I grabbed my title and went to the banks main branch, they release my car from the impound lot. But when i get back in my car and drive off my car starts vibrating and clunking everytime i press the gas, so once again with my keys in one hand and a phone beeping "low battery" i walk back to the counter at the impound lot-when i told them what was wrong they responded with "its the bank, we just do what they pay us for" so i call the bank and they said to go after the impound lot...any advise on who to go after to get this fixed?

I would call the police and report the whole incident immediately.

Wait - why did you conceal the VIN, and if I understand this right, put the VIN of another car on your windows? I don't understand that entire part of the story.

Report the whole incident to the police and call your family lawyer to make sure that he/she has the information ready to start a case if it comes to that.

Well i always cover my VIN for fear that someone with a friend at the dealer with get brave and get a key made for my car, the car that i bought the window from already had the VIN on it when i bought it and i hadnt had a chance to take the number off. What will the police do? ive already made a huge scene with the bank, the police where i live never do shit. well ill call the police

have you ever watched repo man on the discovery channel? those guys grab the car and roll! but its the ultimate responsibility of the tow company to not damange the veichle. yes, its the bank that paid them to tow the car, but its the tow yard that has to do it professionaly. so, i'd go get an estimate to see whats wrong and take them both the bill or threaten small claims court. if nothing, get a lawyer and then you can add aggrivation, and whatever else BS lawyers come up with.

Who cares if his VIN is covered? It's his damn car he can cover his VIN if he damn well chooses to. He went to the bank with his title and they released his car. I would immediately call a lawyer and find out what your options are. You aren't going to get anywhere calling the bank or the impound lot. They are going to continue to blow you off until you go away.

Well i just got off the phone with police and i have to make a report and the detective i spoke with said that they will treat it just like a stolen car. i will have to file a report then give them a few days he advised me to get a lawyer and get the case rolling. When i went to go look at the damage you can see the rear engine mount is completly ripped because i guess they dragged it backwards and they tires in the front are torn up...so i guess i will see what happens when the officer gets to my job

That's shitty...

But like others, I'm very curious as to why the repo guys showed up at YOUR work in the first place.

You say that the owner of the other TL (whose window you have now) was to have his car repossessed... and that's why he wrecked it on purpose.

Now how did the repo guys track YOUR car down to your work? Unless you and the other guy work at the same place with the same color TLs, I just don't get it?? Or are the repo guys that stupid to mistake one TL for a completely different one?

the car that i got the window from was a 2001 but still white w/tinted windows and they said they had been looking for that car...im where i work is only about 4 blocks from the impound lot. they didnt come looking for my car where i work, (there are only 3 white TL's where i live and one i think is a 02-03) the driver said that he happened to see a car like the one they had been looking for

It's standard operating procedure when you knowingly buy a stolen car. Go to the junkyard, lift the VIN off a wrecked car of the same make & model, and replace the VIN on your stolen car. Too bad the bank was out to repossess the wrecked car that he lifted the VIN from.

^^^ Thats right, after a drunken mistake and opening the car door too hard in the garage, a shovel fell off the wall and broke it... so after about two days i decided to start looking for a new one when i found "ryan" who was "parting" out his "wrecked TL

So they just went off a VIN that was etched in the glass? I wonder how many parts from the wrecked TL are on his new car. This could be complicated if his new car has a bunch of parts from the wrecked car on it.

When you buy a car from an individual is there any sure way to know that there are no liens attached to the title?

Well the title they give you will have a lien holders name on it...but i didnt buy the car from him just the window this car has been in the family since 99, so i didnt even think of that. although now i will be EXPONETIALLY more careful

But of all the TL's on the road how do you mistakenly track down the one that only has the driver's window of the car you are looking for? The owner of record and license plates wouldn't match what you are looking for. Did the repo man just randomly check the VIN of every TL he saw?

well ive gotten with the bank and they were very friendly...but now im getting a lawyer. they were only willing to pay half of the damages "for a car that year..." and other bullshit, they basically told me that it the car could have already been damaged and with as many miles as it has...152k. as far as im concerned this car has just been broken in. where i live isnt so much a small town as we only have a few chevy dealers, a bmw-landrover, honda dealer, there aren't very many Acuras around the closest one is 5 hours in any direction and for the repo guy i could kinda understand as even i was shocked. the guy who sold it to me had an almost identical car and like i said earlier, i only work like 4 blocks from the impond lot so its not like they couldnt have driven by and seen the car

A lot of people will switch plates if they are past due. The only way to tell is by VIN. Also, if people know they are out for repo, they will try to be sly and cover up the VIN. Almost all repo guys will ignore the license plates. If the repo guy is getting desparate, he will check the VIN of every car that color. They don't carry around a database of plate numbers for them to look up. This all comes from personal experience.
