Anyone Familliar with TX Lemon Law?
Truck is going in for its 5th service for the same issue. What I can find is that 4 unsuccessful repair attempts in 2 yrs/24k miles qualifies.
Aside from the submission process, which is outlined on the TX DMV site, I don't see much in how things proceed past that.
Have an appt Sat morning to see if they can fix it, if not, the process will begin.

If the dealer doesn't want to work with you then after the required repair attempts, file your submission (the form is available on the txdmv website) with filing fee of $35. Notice should automatically be provided to the dealership if you use the web form. They will contact you for one final repair attempt.
If the repair attempt fails or the dealership is unwilling to do it at all, the matter will be referred to one of the area State Office of Administrative Hearings (SOAH). The SOAH office that handles most of Harris County is on the north loop of 610 near TC Jester (the exact address is 2020 N. Loop, Suite 111, Houston, Texas 77018).
SOAH will try to broker an agreement, but if not possible, they will set the matter for a hearing. In my experience, the hearings are very lay-person friendly as long as you come prepared with documentation of the problem, attempts to fix the problem, and a clear idea of what you want. Possible resolutions include repurchasing the vehicle or replacing the vehicle (less the RAFU discussed above).

First, try to see if the dealership will work with you. Ultimately that is what the Lemon Law will do (it can potentially force a buyback or replacement, less a "reasonable allowance for use" (RAFU) charge. If the dealership will offer something it may be worth a look.

I emailed and then followed up with a call to the GM and he guided me through the process with MBUSA. He was able to get things moving fast, he literally told me what to, and what not to say..
Good luck.

Thanks guys. The dealer where I bought the truck & have done all service with, my service writer isn't there anymore. The guy I have now seems less than willing to try to be helpful.
May have to make an in person stop and talk with the svc manager/GM & see where this goes.
Tough part, is I'm bumping right up on the mileage limit for lemon law.

If necessary, file the complaint now since you've already given them the (4?) opportunities to try and fix it.
