Accident dilema...
Alright guys, so on Turkey day, my friend needed to leave the party early. To get out of the driveway, my friend's cousin and I were blocking his way (I parked behind his cousin's Subaru). So his cousin gets into his subie first, and starts up the car as I'm walking to my car. As I get down the steps to the driveway, I hear him rev and then hear a loud metalic SCRAPEEEEE. Fuck. He backed into my car. My bumper, and fender are damaged, and when I went to open my door, I heard a POP. The fender is hitting the door when it's open.
So anyways, I need some advice... So, since the accident happened on my friend's driveway, his parents want him to pay half of the damages to my car. I really feel this is unfair because he did nothing at all to damage my car. I don't even feel he should be involved in this at all. But I guess his parents mentality is if it happened on their property, they should pay for part of it.... I don't really agree with that at all, but who am I to say anything? I guess his cousin doesn't want to go through insurance because he loses his good drivers discount, and 7 years no accident from All State, but that's about it.
What would you guys do in this situation? Should I just get this handled through insurance?

If I were the cousin, I wouldn't let the friend pay anything, I'd just pay you directly, without insurance.

so the cousin pays half and his friend pays half? Ask the cousin to see what he thinks. If he is ok with it, then so be it. If the cousin also feels uneasy by letting his friend parents pay for other half, then let the cousin pays for the full damage. Either way, no need to go for the insurance since the cousin didn't want to ruin good driver discount unless the cousing and his friend only pay for half and you have to pay for the rest. Make sure talk to them first before you report to insurance.
Get an estimate, and ask for cash. If not...just go through insurance. That is always the most sound thing to do. That's why you pay monthly on it, right? This is your chance to use what you pay for. Also, it will be your friend's cousin's insurance, so you won't be penalized at all for it. It would be better if you could've gotten a police report, but I think everybody knows what happened, so you should be ok.
i'd say try and get all the money from the cousin
he's the one who hit your car= he should pay
he doesn't want to go through insurance=again he should pay
cuz both things are an inconveniance to you, either way just get your money, just tell your friend to get the money from his cousin and not talk to his parents at all about it, i'd say either way i'd want the full amount doesn't matter who pays IMHO i think the cousin should pay it all
