[RANT]
It's 20 minutes already and I haven't recieved your email. WTF. Email sucks. Gonna kick the crap out of my service provider.
[/RANT]
Erm... on a separate note, this may be a dumb question, but is the intake for a 01 CL-S? Your ad didn't say, and I kinda just err... assumed...

This damn well sucks. It's 5 minutes before midnight PST and I still haven't gotten the email yet. Darivative, could you PM me your paypal info? I need to go my ISP
Also, yeah I know it's for the Type S, but is it for the 2001 model? I need to be sure cos the 2003 CAI won't fit the 2001 models. Thanks!

I really wish I could say that I got your email, but nope... one day later, I still don't have your email. Could you resend the email and PM me? I'm so sick of my ISP now.

Darivative!
I got the package you sent... And it is NOT NOT NOT what I would consider a brand new, never installed AEM cold air intake with no scratches on it.
Thread here:
http://www.acura-cl.com/forums/showt...threadid=71417
I'm hoping I made a mistake. If not, I'll be waiting for an explanation and/or my money back.

Darivative, to quote your words:
I have a brand new in the box, AEM cold air intake for the acura cl type-s in silver. 100 shipped next day air is more than fair since it's in good condition with no scratches.
and
It has never been installed and there are no scratches on it
My response:
1. No, it is NOT "for the acura cl type-s". It is probably an 98-00 Accord V6, or maybe a CL-P, intake.
EDIT: As confirmed by several ppl, it is an AV6 intake with a 2.5" pipe.
2. No, it is NOT "brand new in the box". For one, the filter has obviously been used for at least a few thousand miles. There are lots of signs of obvious wear on the intake.
3. No, it is NOT in "good condition with no scratches" as the pictures will show you. There is at least one large gash.
4. No, it is NOT "never been installed". It has obviously been installed and removed as can be seen by screw marks.
5. Yes, you did throw in the bypass valve, and I do appreciate the gesture. However, one tab on the bypass valve was broken. And personally, I don't intend to use the bypass valve, which is why I didn't even ask about one in your sale.
Based on the above first 4 points, I believe I am not getting what I paid for. And based on popular opinion as seen on this thread, I am not being overly picky about what I expected versus what I actually received.
Frankly, I would have accepted it even if it had turned out to be lightly used instead of brand new. But I checked my friend's 4 month old/5000+ miles intake, and it is in better condition than what I received.
Yes, I would like my money back.
No, I do not feel that I should have to pay for return shipping considering this product is very blatantly not as advertised. There is absolutely no reason why I should come away from this transaction paying for the cost of return shipping.
Of all the descriptions you used on the item you sold, the ONLY two facts that were correct were that it was silver, and it was made by AEM. Everything else was flat out and very obviously wrong.
Please let me know when $100 + cost of return shipping has been deposited into my paypal, and provide me a return address. I will repackage and return your stuff to you, and we can close this matter.
I will not consider anything less as a satisfactory resolution.

Look at the difference, fucking scammer

Also I believe the CL-S real intake from AEM is a 1 piece while the one you sent him is a two piece. I don't even know if the box you sent him is the one from AEM....when I ordered mine, it came in a white box with AEM in blue on the sides and inside were a license plate holder, two stickers, catalog, instructions.....etc.

Darivative:
I already pointed out how the item you sent me was NOTHING like what you advertised. Unless you can provide me a really good explanation on my 4 reasons why I don't think I received what you advertised, I absolutely will not accept anything less than my $100 back + cost of return shipping if you want your intake back.
tw112:
Nope. The box was labelled "Property of US Postal Service Flats Tray". No stickers. No license plate. No blah blah blah... No CAI even.

I emailed you the info about the intake and told you the intake was used and that I would throw in the bypass valve for the mistake on the ad. I even offered to send you pics but you declined the offer. I don't need to sit here and get bashed because you are unhappy, since you got what I told you I was sending. Now either I paypal you the refund and you ship the package back to me or not...
P.S if you don't want to do that I will see you in court!

For the record, this is from my paypal records:
I do not recall ever getting any email from you saying that the intake was used, or that you would send pics, much less sending a reply declining the pics.
But for the sake of argument, let us imagine that I was really stupid, and I said, OK, it's used and OK, I don't want to see pix. I am not saying I said that, but let us take a moment and imagine...
That still leaves the FACT that the intake you shipped me is NOT a CLS intake. 2.5" vs 3" pipe. 2 piece vs 1 piece. 2 bends vs 3. Extra nipple where none should exist. Hmm...
The only "threat" in my email was this:
Darivative, no matter how slice and dice it, face it. You shipped me an intake that was NOT for the CLS. You're 26 years old. I'm sure you're smart enough to realize you've made a mistake and shipped me the wrong item. Just accept it, let it go and refund my money + shipping.
If you strongly feel that you upkept your end of the bargain, then feel free to ask your legal counsel to contact me. Except that if it goes to that, I will also be claiming for any inconvenience caused me. I have no desire to bring in lawyers, BBB or even paypal into this, but I will if I have to. After all, there's about zero chance of me losing. It's your call.
Oh, and by the way, if it does come to legal action, I will definitely ask for proof from your ISP that you did send me email telling about the used state of the intake and offering me pix. I will also ask for a receipt from your ISP for the email where I stated that I declined pics. I'm sure you know how ISPs keep track of things like emails going in and out. And if by chance either or both emails were found to not exist...
Anyways, it's your call how you want this case to proceed.

Intake
Note:
Just to be sure, this $100 is for silver AEM Cold Air Intake for 2001 Acura CL Type S. The CAI is new in box, never installed, never used, not defective in any way. I don't need signature delivery confirmation. Thanks!

You have 24 hours from the time you read this message before I take legal action.
I don't mean that as a threat. I know mistakes happen. If this is an honest mistake, hey, no problem. Just fix it, and we can all be happy.

Read the thread I have reciept of 2 emails that I sent you that you mysteriously didn't get so I got that covered and the emails I sent states me telling you it's used and would you like to see pics, so I also got that covered. Your the one that starting this so it's up to you how you want to finish?
From the start I stated if you want me to refund your paypal account (NO PROBLEM) but you are still going on about the shipping, so you want me to lose double the shipping amount for something I told you I was shipping. I don't want to be involved in any legal actions but if it comes to it that's your decision.
Let me know...
P.S I sold stuff to other members on this forum and never had a problem...
PP.S Who in there right mind would sell a aem cai new for 100 shipped? Shouldv'e known you were a buckler from the start...

We can argue about who sent who an email, who replied what in email. Whatever. You are still missing the biggest point.
Fact 1: You advertised a CLS intake.
Fact 2: I paid $100 expecting a CLS intake.
Fact 3: You shipped a AV6 intake.
Do you dispute any of the above 3 facts?
If the above 3 facts are true, then we can come to the conclusion that you did not ship what you advertised. As such, I do not understand why I should have to absorb loss in shipping.
