um, if this is on the street and you had enough reasons to believe it was alcohol you could look in the bag (alcohol smell, stagger, way of drinking, etc...)
in a car i would imagine I could just look in it in the interest of public safety... ive never actually had this happen, usually i see a bottle under the seat and BLAMMO its mine
