What are my options?
What are my options?
So less than three weeks ago I purchased a brand new (11mi on the odo) 2009 TL w/ tech package.
A day after, the car sat in my backyard, the battery had drained and I boosted it back from my TSX
.
The next day I figured out that the passenger side door handle doesn't work with the key-less entry system as it is supposed to. The handle does not sense a hand nor does the black lock button work.
Furthermore upon delivery one of the engine cover tap screws are missing and the under-body plugs were not installed. Also the center console trim kept popping up.
Service visit #1:: They found that a whole battery cell was dead so they replaced the battery. They ordered a new front passenger side door handle and the engine cover tap-screw and under-body plugs. They told me the center trim was re-secured. Note, service adviser said he had his top master tech look at the door issue.
Service visit #2: Engine cover tap screw installed. I was told the under-body plugs were installed but I just looked under the car and they are not. Had them check the center console trim as it popped up again. They replaced the door handle but problem still remains. Service adviser stated that the mastertech avalailable is not his best and that they were unable to fix it and that I need to bring it in again. He said they don't know whether their is a brown-out, short-out, infrared, or ecu problem.
I am taking the vehicle in Tuesday for attempt # 3.
***Now to my question, since I am still under 30 days since the day of purchase, what are my options. Would anyone return the vehicle, ask for a replacement, ask for a replacement plus a bonus/upgrade.
I am mad at the fact that my car doesn't have 500 miles and it is already being toyed with at service.
Hope to hear from y'all. Thanks.

Until the car has been in for service at least 4 times for the same problem, you do not have a case under the NY lemon law. In addition, the problem with the car has to affect the market value negatively, but I think you've got that covered. (The NY Attorney General told me they've gotten people's money back on leaky windows that were not fixed properly).
I had a couple of issue with my new TL as well that took three long visits to fix. Although others haven't had the same success as me, I got the best service by contacting Acura HQ to get them involved and being persistant with the service tech and manager at the dealership. I was never rude, but I let them know that there were only going to be two possible resolutions--Fix the car perfectly, or eventually go to lemon law arbitration.
Once they know you're not going away, it'll get fixed right.

I know it must be very frustrating but be patient. These are somewhat minor issues that you will forget easily once it's fixed. It sounds like your dealer is not the best. Are there other dealers in your area that you can go to? If not the you should definitely reach out to Acura and let them know of the multiple trips you've had to make with no resolution yet...

Lol, it is Paragon.
Honestly I have to say that their service has changed 180 degrees. They haven't paid me to say this but even their sales has changed. I have been going there for nearly 3 years b/c I still own my TSX and I knew and know everyone service/sales rep there. From the mouth of one of their own service consultants, they fired nearly everyone in service and sales and went through a series of service managers. I definitely see a difference as every time I go I am treated like a million bucks. They are more informative and friendly, and have honored hundred upon hundreds of dollars of wear and tear repairs/service on my tsx. I do pay it back by giving them 5's and 10's on their follow-up surveys.
Also its convenient for me. I live 3 blocks away and dont have to worry about loaner cars and bull. They even offer me the shuttle to my front door but I refuse unless its raining. And also when I tell them to not hand wash my car they listen, even though I think they do a good job.
Ive had blowouts with previous service reps (those who i dont see today) and called corpo on them about a year ago. On rep told me that Paragon noticed that its service was the worst and that they needed a major change.
For real its nothing like it used to be. So far after the change, I have dealt with Kevin C. and Chris U. an in my oppinion they are both the best. Kevin C. has been with service for a while and Chris U. was grabbed from Honda across the street to help turn around acura's service at paragon.
Try it an d let me now how it goes.
One thing I still see at paragon service is their thuggish techs which they cycle through pretty quick. Its the guys I don't see doing work on my car that I don't like.

I WENT THERE 1S FOR SEVICE with my 3g never again..my friend is takin them to court.for is 09 TL...THEY SOLD HIM A LEMON THE CAR SUN ROOF DIDNT HAVE ANY DRAIN HOSE SO WHEN IT RAIN THE WATER DRAIN INTO THE FUSE BOX...THEY HAD THE CAR FOR A MONTH.WHEN HE GOT IT BACK HE DROVE 2 BLOCK N THE CAR SHUT DOWN...THEY HAD IT FOR COUPLE MORE WEEK...THEN THE FUSE BOX CAUTH ON FIRE..LOL
If Acura is serious about maintaining its repuation, they should shut down Paragon Acura IMMEDIATELY. It is the worst dealership I have ever had the misfortune of visiting. I wouldn't buy a roll of toilet paper from those dispicable crooks.
I purchased my car from Rallye Acura and the car was delivered to me 100% in perfect order.
Interesting how horror stories like this invariably seem to involve that cesspool of a dealership.

Oh, and BTW there's no way in hell that car rolled out of the factory the way you describe it. No way whatsoever. So I suspect something far more sinister has been going on with this vehicle. Especially in light of your contention that it had essentially 0 miles on it when you picked it up.
That kind of shit just doesn't happen with Acura's. I'd get in touch with the Attny. General's office. You may be looking at out and out fraud here.

My story is:
Worse experience by far. Spent 2 hours trying to get a lease on 2010TSX with tech. package. Started out good, got the test drive out of the way. Thats when all the fun started.
Marvin and other sales people at the dealership love to go talk to their "managers" every time he went there he would disappear for 15 minutes at a time. So first time he leaves, comes back later and gives me a crazy lease numbers. So I play along and explain to him that this is not the first dealership that I visited. I also give him my color options. He leaves again, comes back 15 minutes later and starts asking me "What can we do to make this happen today" at this I told him what would make me get the car today which was a very reasonable number. He makes me initial a piece of paper so that "he can take it to his GM and tell him that I actually intend to do this today". This is the stupidest thing I ever seen. I play along and do it. then he asks me to give him credit card and my driver license
. again very stupid thing to do. He comes back 10 minutes later and and tells me that GM accepted my offer and we can proceed. He tells me that he has black and black car available and I can drive out in a new car today. That's when things went from bad to worse. Turns out according to him "we only have 2 cars in stock. One black and 1 white). I ask him to show me the black one. He takes me outside and shows me the same car that I test drove. I told him that I will not take a used car. He proceeded to convince me that its a new car and the lies started. First he tells me that nobody else drove the car except me. its still brand new and he tells me that it only has 12 miles on it. Problem with this is that I negotiated pricing on a new car, not a test drive car.
I proceed to tell him that and I tell him that I will consider it if he adjusts the price. He leaves again, comes back and says "great news, GM agreed and we will take $100 off the out of pocket cost." then he proceeds to tell me that car with 12 miles on it is brand new and there will be no problems. he also tells me that he will give me a receipt so i can come back on Monday and get the car detailed because it was covered in spots since it was parked outside. That means that I have to drive 20 miles each way to the dealership on Monday to get something done that should be done before the car gets to me. At that point I go outside to inspect it and I ask him to show me the mileage. he starts the car and tells me that car has 26 miles. At this point I get pretty upset since this is lie number 3 in a span of half an hour. 26 miles on a test drive car is a lot and I know how people treat the test drive cars they drive. everybody pushes it to the max to see what it can do. I'm one of those people. So I call him out on his lies and tell him that the price needs to go even lower. Of course I gave him choices. option one was to find me brand new car in my color and I would pay the price negotiated. I take this car and you lower the price since its used and he lied to me.
At that point he leaves again, comes back to me and tells me with straight face that "GM doesn't want to deal with me anymore". My advice is to avoid this dealership and save your self a headache.

In 2004 i have bought brand new TL with constant vibrations. In 2006 acura bought back and i ended up with 2006 brand new TL thanks to lemon law http://www.lemonlawclaims.com/.
After my visit there on Saturday to lease a new tsx I completely disagree. I spent 3 hours and their level of customer service as well as professionalism went downhill right after test drive. In the beggining everything was good. salesperson got me the test drive and all hell started as soon as we sat down to "discuss numbers". I'll post the long version which i actually documented when I got home below but the short of it is that I went to dealership in NJ and drove out in my 2010 TSX in 2 hours. Totally different expirience than I got at Paragon.

The point is that salesperson kept lying to me. first it was "yes we have the color you want in stock", then its "you are getting the car you test drove", then it was "car has 12 miles". If the salesperson would have told me from the beginning that would have been different.
I was negotiating a price on a new car. I know that 26 miles is not technically a used car, but it was the car i test drove and 26 miles is a lot of test drives or something else. After numerous lies I just had enough. If the salesperson told me from the beginning that all they had in inventory was 2 cars, which I find hard to believe btw, I would have been fine and would have probably bought the car. Plus it was a total experience that makes you feel like crap. At the start of negotiations they jacked up the lease rate by over $125 a month from what it was suppose to be. Their sales tactics are not that good. So whole point of the story is paragon and NJ dealership i went to are totally opposite. They both have same goal of selling cars but the way they do it is completely different. I have to say that I as a customer prefer to be treated like i was in the NJ Dealership.
Btw the car I got from NJ dealership had 8 miles on it and I saw it being unwrapped and prepped in front of me while i was signing the paperwork.

I never dealt with the acura side of paragon, but the Honda side was the pits when it came to service. Tranny went out under warranty it took 3 weeks to fix and I had to bring it back because my D4 light kept blinking. And they always promised it would be done tomorrow, then tomorrow. Worse service experience I ever had, and the worse part is that the service department kept m number and must have given it to sales. The kept harassing me until I said I have an infiniti since your service took so long. That was before I went to Rallye Acura and picked up my TL. It sucks when there is only one Acura dealer for one set area, meaning 1 for Brooklyn and 1 for Queens. So they don't have to be as competitive as the ones in Long island where there are 3 in nassau.

.. fixed or they'll end up buying it back.. Hopefully they can correctly address the issues this time.
