2007 Type-S won't start (sometimes)

I bought a 2007 type-s in February. Everything has been fine until about a month ago...

I turn the key, hear a click and the car doesnt turn over. Its very intermittent, but the frequency is increasing. It started a month ago. Then happened again 2 weeks ago. Then last week. Today, its been doing it all day. Eventually, the car will start.

I drove to the parts store and they tested the battery. The battery is good. Additionally, the lights dont dim when i turn the key.

I've searched and it sounds like the starter is going out. You guys have any additional ideas?

is it just a single click or a rapid clicking sound? If it's a single click more than likely it's the starter or starter relay that is failing.

Its a single click.

Where is the starter relay? Is that a fuse, or something else?

I had this happen to me one day, I thought it was normal due ULEV? If not I'm still under warranty and I'm going to take my car in!

I can't remember exactly where it is but I think it was either a relay in the underhood fuse box or a relay in the fuse box in the driver footwell.

Is this due to ULEV?

I turn the key and it takes about 3-5 seconds to start up. Somedays this happens to me 2-4 times, somedays it never happens.
