When a car is sold, who is responsible for the inspection?
The seller is required to provide the buyer with a valid smog inspection certification at the time of the sale or transfer. Smog certifications are good for 90 days from the date of issuance.
The inspection is not required on a transfer if a biennial smog certification was submitted to DMV within 90 days prior to the vehicle transfer date (a vehicle inspection report may be required for proof of certification).
Note: Smog certifications are not required for transfers that occur for any motor vehicle that is four or less model years old. A smog transfer fee will be collected from the new owner.

Whats the big deal. If selling your car and it has no mods to the engine- smog test are fast and painless. Here they want 50 bucks but everyone has coupons for 29$
Those selling a car in doubt of it smog legality can get a "pretest" for 25
And yes, it is stupid that they make you do it on a car with less than 5 years/50K miles on it- but only if selling it- then the buyer knows the car is legal
At least the time under emissions warranty, you do not even go to smog check the first 4 years of a cars life

it is all dependent to your state... in NJ you are required to get your car inspect every other year regardless... in TX it is yearly regardless... and im pretty sure that in MD you only need it inspected after the owner of the vehicle changes hands??? MD peeps correct me if im worng???

Definitely state specific.
Personal example, I sold a vehicle shortly after moving to TX. It was still registered in my previous state of residence and as the seller had to get it smog/state inspected prior to finalizing the sale.
