Totaled my TL <--This is my first thread
Last week I was driving in rush hour at 40-50mph, checked my blind spot to merge into the right lane, when I turned back around, the traffic in front of me stopped. I applied heavy breaking and attempted to avoid the semi trailer parked in front of me. All attempts failed. The driver explained after that he was suprised that he could slow down enough to not hit the car in front of him and it was a wrong place wrong time collision.
Word came back from Progressive that my car was totaled and I'm in the market for another car . I was looking for an affordable RL, but a service writer at a local Acura dealer advised me against them. So I guess it'll be back to another 6sp TL.
I bought the 2004 TL 6sp (no nav) in Fall of 2008 for $14.6 with 53K on the odometer. I thought it was a good deal at the time. The car now has over 91K and Progressive setteled for $13.4 so I think I got my moneys worth out of the car.

Sorry to hear. It doesn't take much to total these cars. I just went through the same thing myself a little while ago.
I wound up with a diff vehicle though. It's funny, it's the vehicle that's behind yours in the photo!

Glad your ok, good news is that it sounds like you get a good amount of money from insurance, even more than I would have expected. Did it have any aftermarket parts on it?

Correct. Retail value is what you go by. What the car is worth today if it was sold. That is what he should get. All he has to do is show them this and he should be able to get the difference.

They used NADA to determine the replacement value. It is a 6sp manual with over 90K on it. NADA takes a deduction for manual and for high miles.

If you like the sporty nature of the TL, which I gather you do since you want another 6spd, your not going to like the RL at all. It's a bit slower and a bit more numb to the road than the TL. I'd advise you to check out a 2007 TL-S, you might be able to find a good deal on it! As well do challenge your insurance and make sure you get a fair value from it.

lol, insurance uses market value, what the car would sell for at a dealer.. they simply call dealers and ask them how much a car would go for in the condition and options it has...certain cars sell more than KBB and NADA values all day. they need to give you replacement value... thats all i would argue with them... is that they need to give you enough money to put you in a car with similiar miles and condition, I would have the adjuster call your local dealer and ask them what they are going for.... I'm actually kind of surprised they totaled it. Probably a good thing though, it wouldn've been the same after the repairs.
Have you looked at other cars? G35 quickly comes to mind, and you could get some for a nice bit cheaper.

Most insurance companies including Progressive uses NADA's business version for an ACV- not the public on line version. They take the clean retail value of the car with the options and mileage factored in. If there is any prior damage to the car they then take an additional deduction. That is how they made their offer to you. You can argue the value of the car, but ultimately the value of the car stands. Your insurance policy likely has an appraisal clause that states if you dispute the value of the car you and the insurance company can each hire an independent appraiser and they will average the two out for your settlement. This will not get you anywhere- the value will be similar to their offer and then you have to pay for your appraisal. Unless your insurance policy was written so that you get a comprable replacement, then they only owe you for the ACV of the car.

when i totled my car a few years back, i went and found the exact car for sale at a local lot, got the sales price, added tax title and license, and gave all that info to the insurance (not my insurance as the wreck wasn't my fault)...i basically said i wanted the exact same car with similar mileage that i had on it when i wrecked...this argument got me about $1,000 more then the original quote (statefarm)....

Thanks for all the input everyone. I've actually found a better deal on a 60k TL with 6sp, aspec, nav, and tint.
I'd love to pick up a type-s, but just can't bring myself to spend the money just to rack up miles like crazy for work (1100-1500 each week).
I've disputed the cash value already. I didn't know you could include tax as well. The rep just used NADA which deducts for 6sp and I explained that everyone selling a manual is asking more since they are so rare. I will have to call her to ask about tax.

I've thought about buying it back, but it had some paint work done before I bought it that wasn't very clean anyways. I have a friend that is thinking of buying it from me if the buy back is low enough. I heard 15-20%, but dont know for sure.
