TL was hit last night
RANT!!!!!!!!!
I am sitting at a red light, 1/4 mile from the house, minding my own business. This guy smacks into the ass end of the TL and I hit the neon in front of me. The guy says, " I saw the light turned green (10 cars in front of me) and never saw you. I am sorry". My friends girl went to the hospital by ambulance (back pain) and I fawked my neck up. I ended up at the hospital for 4 hours last night, nothing major, but a ton of pain for the both of us. Everybody else was ok. He was driving a Chrysler and hit me at 40MPH. This is where it gets interesting. The front of my TL has a small scratch and dent in the bumper, the Neon is fine. The back bumper of the TL is torn up pretty bad. There are two gashes in the paint. They are both at the top of the quarter panels where the trunk lid is. VERY WEIRD!!!! The back door jams and trunk lid do not line up anymore. The damn EMT's hit the left rear quarter panel with the stretcher and put a dent in it.
I will post pics tomorrow.

damn man, sorry to hear... 40mph is friggin fast to be rear ended! glad you guys are ok for the most part... probably be a little more sore tomorrow as it takes a day or two to feel it fully.... no worse feeling than a car accident- esp. when its not even your fault. i've had my fair share and i can relate. i had my tl for 27 days before i got rear ended by a 17 year old kid in his parent's range rover with the extended metal bumper/headlight grill... i was so pissed... hey, the car can be fixed, important thing is that everyone is ok.

Thats the only crash test area the TL scored poorly in, feel better. I say go to a chiropractor and send this guys insurance company a 10k bill in a year, thats what happened to my friends dad when his ABS malfunctioned and he hit someone.

40mph rear-ended will demolish a car and the car in front of it and most likely deploy airbags (from sudden acceleration then deceleration).
This is what a 40mph crash looks like:
People have a tendency to way overestimate speed when they're involved in a collision. With a misaligned trunk, scratched bumper, and jamming back door it's hardly more than a fender bender.

1. I would be too lazy to go to a chiropractor, I would just buy that cool 6k massage chair from sharper image.
2. His dads saab aparently had a known problem with the ABS in wet weather(1993 9000Aero), so basically it didnt stop the car as well and it didnt stay on a straight trajectory. I believe he argued that in court to try to avoid the 6-7k in charges for a chiropractor. He lost

That really sucks about the accident, JWhite. Hopefully you and your friend can get the medical help you need and get back to normal health. I know way too many people who have been in accidents and are affected by it for the rest of their lives. Good luck with everything.

This is one reason I got a white car.
I had a white mustang for 5 years, no accidents.
I had a white chrysler laser for 10 years and no accidents.
I had a black el camino and it got totaled 3 times in 2 years.
I had a light blue Jaguar (arctic blue) for 6 years and no accidents.
I had a white passat for 2 years with no accidents.
Very dark cars tend to be invisable, and I get a big kick out of the fools
driving a dark grey car in the rain at dusk with no lights on.
Dark cars get backed into, driven into, cut off, etc.

Thank you all for your concern. I am much more stiff now, than I was. I do not need any more medical attention though, nor do I need a lawyer. The guy and I have the same insurance agent, go figure. My car will be fixed with all Acura parts. They are going to give me a degradation (sp) value as well. This is the difference between what my car is worth never in a wreck vs being in a wreck. Their standard medical offer is 3 times my medical bills. I told the guy that I want my health and financial condition to be returned to their state before the accident. I do not want to sue anyone. So far, so good. My car is at the body shop of my choice, I have a 300M rental, and medical bills are already being paid.
As far as the 40mph part, I cannot say for sure, as I was not driving te moving car (just the target). The speed limit is 45, he said he was doing 40 and did not hit his brakes until the last second. The body guy told me this is where I got lucky. His car went under mine, causing most of the damage to his car. My trunk is caved in, under the bumper. When you pop the truck, the floor mat is bulged up.

Maybe in the arctic, a white car is not good, you want black...

I ride a motorcycle, and have ridden a LOT, and you notice things, like you
are invisable.
Its subconcious brain activity, a person driving a car and thinking about
beer, food, whats on tv tonite, work, etc, looks to the left and sees a motorcycle,
but they are sort of on auto pilot, and in the back part of their brain, the message
is 'it will bounce off the car' and they pull out right in front of you.
Now if I was driving a big truck, or an old pickup truck with a steel I beam bumper
and dents all over it, the back part of the brain says 'thats going to hurt!'
and they dont pull out.
Dark colored cars are somewhat similar, you have to pay attention to see them sometimes.
I do a LOT of driving for work, and look at all the accidents I see, and I see
a lot. Most involve a dark colored car.
I twice backed into a car, dark blue car in a tree shaddow at night.
The car was in the shadow of a tree under a street lamp, in the rain.
I would have seen it if it was white.
The other time a dark car parked in a non parking spot behind my van.
If the car was white, I would have noticed it in the rearview.
The one black car I had was somewhat deadly, I was once driving down street
road in PA (2 lanes each way) in the day, bright and sunny, bare concrete
road (not blacktop) when a car made a left right in front of me.
They waited at the left turn lane, looked, then pulled out right in front of me
when I was doing 50 mph.
Both cars made out very bad, they wound up in a ditch, I stayed on the road
but the front and side of my car was trash, as I got right up on the center
concrete barrier to try to squeese by them.
I always found dents in that car, and once a bus ripped my bumpr off and kept going....
Never had a black or dark car since and have not had any accidents in 18 years!

jwhite.. sorry to hear about your accident man but at least everyone in your car is okay.. just make sure you go get the treatment you need to get better... living the rest of your life in pain and not 100% functional sucks.. .even if it includes not being able to move your arm a certain way....

I used to work for a personal injury attorney, so I dealt with this kind of stuff all the time, and I hate insurance companies in part because of that. Yeah, sometimes it's one of us trying to get money out of them we don't deserve, but more often than not it's the insurance company not owing up to their responsibility to pay for covered losses. Could tell the story of a family that lost their family health insurance because the person lost her job because of her injuries, and while the insurance company was steadfastly refusing to pay for the health insurance, her husband was diagnosed with diabetes, and now he had no coverage. Nice, huh? I have lots of stories like that.
At least in your case it sounds good so far -- even offering a degradation compensation, something my mom didn't get when her Civic with less than 1000 miles on it got rear-ended with almost $7,000 worth of damage. Sounds like you're doing the right thing too, not settling until you feel fully healed.

I am glad to hear your okay and that your being well taken care of.
I am also glad to hear you aren't going sue happy over this, too many people look for this type of opportunity to milk the Insurance company out of everything they can get.
Like someone mentioned before that is why rates are so high in the 1st place.

I am not much of a medicine person and have never done drugs on a steady basis. But the pain pills and muscle relaxers make everything go away....LOL!!!!!
