Stolen tl!!!!!!! Chicago area
Hey Guys,
My car was STOLEN last week. I had attempted to sell it, and the bank issued check was fraudulent!!!
it's a 2004 WDP, beige/tan interior, navi...there is also a small crack under the front lip that the dealership did a poor job repairing.
The car was stolen by the Water Tower Place on Michigan Ave in Chicago. The individual said he lives east of Chicago near the Indiana border.
I filed a police report already and claim with insurance company...please keep your eyes open for it
It has wood-grain interior and a WOOD GRAIN SHIFT KNOB, pretty Unique
if you find it call me immediately!!! Alex- 414-232-7276

Not alot you can do with a bad cashiers check. I would take the person to their bank to close a deal. Have them cash the check and hand you cash. Depositing yourself they can take weeks to come back bad at times.

Sorry to hear about your TL. Really bites. I won't touch a cashier's check. Too many scammers out there. I have a 84 Dodge Charger for sale and I got an email from a guy in Alabama wanting to buy it. He said he'd send me a cashiers check and arrange to have the car shipped. I was thinking, hmmmmm, sounds fishy to me. Buyer beware.
Hope they find and fry the guy and you get your TL back. If not, hope your insurance covers you. Good luck

Man, that sure sucks! I'm so sorry to hear it, and curious to see how your insurance company handles this.
Technically the wasn't really stolen, as much as scammed away from you. The fact that you signed it over voluntarily makes me wonder what they'll say about your claim and if they'll try to get out of paying off.
In any event I wish you all the best of luck. Please do post follow-ups.

Take it too court and say the recipient falsified a check...provide pictures of the car under his owner ship. And pray. The other guy would probably see jail time for vehicle theft and fraud.

the "other guy" can just sell the car and show a signed title to the buyer - essentially never registering it in his name.
Many people do this. Mainly because if you sell more than 2 cars per year you need to have a dealer's license. If they never sign the title, it looks like there was no middle man and the car was sold from you to the 3rd guy.

GO TO THE BMV AND ORDER A NEW TITLE NOW! The new title usually ALWAYS supercedes the old one in number. State the old title was stolen. Just an idea to think about...dunno. Dont have time to think it out right now to see if its valid. Would stop them from using the old title wouldnt it? My guess is....it will be parted out and stripped anyway. Otherwise its going to show up somewhere and somebody might have some explaining to do.

Ok....my brother is an insurance agent....works right in same building I do. Talked to him a bit a few minutes ago...
In order for a sale to be legally complete....there has to be three things:
Offer - Acceptance - Consideration
You lack the third aspect....but instead were given a fraudulent check which is worthless. Contract was NOT fullfulled. Therefore sale never happened. Your insurance company very well may pay off on this as a stolen vehicle given the above facts. YOu need to do TWO things RIGHT NOW. Call the Police (I am assuming you did this already) and call your insurance agent and report it as a claim and stolen vehicle. They should take it over from there.
If it was not fully insured against theft....then I would revert back to my first idea....RETITLE IT NOW! It would stop them from being able to retitle it out from under you...but fact is that is likely NOT going to happen. What they will likely do is part it out (likely already in Gary in three thousand peices) or trade VIN's with one in a junkyard and sell it as salvaged repaired vehicle....which will still get a decent profit given what they actually paid (or didnt) for it.
I am hoping to God you didnt own a car worth that much without full coverage. Please tell me this is not so. If its fully insured....actually...this may be your best buyer yet! Insurance companies pay a fair price when you negotiate with them a bit.
