Help! Carport collapsed on my new car

Unhappy Help! Carport collapsed on my new car (have pics now)

Crap, snow accumulated & caused the carport at my apartment complex to collapse on my car. I'm so pissed... The back window is smashed & a beam is lying on the trunk.

How well do you think the dealership will be able to repair it??

I'm so sorry to hear that. You'll probably need to take it to a body shop for that.

The dealership will just end up sending it to whatever bodyshop they use on a regular basis. I know this for sure. Make sure you don't put a claim in to your insurance company. Your apt complex should be responsible. Thats why they carry insurance.

Actually, the apartment complex will probably not be responsible for this one, unless you could prove them negligent in some way. You could try to get something out of the complex, of course - but you will probably need to go to court to get something from them for this type of accident.

This will probably have to be covered by your insurance. I hope you get good results ...

A friend had his car pelted with huge a$$ acorns at this apt complex. It was his assigned parking spot and he had requested to move or cut that part of the tree down. The did nothing, a week later after a vacation he comes back to see that he car has a bunch of dimples on the hood roof and trunk. They apt complex ended up paying for it but not without a fight though.

As far as liability, you might have an engineer check to see if the carport was designed in accordance with your local building code requirements. If the snow load was more than what the code requires, then the carport owner would probably not be liable.

Bxscip, I've never seen acorns big enough to damage a car. Are you sure it wasn't walnuts?

Take it to several body shops yourself, but also ask the dealer who they use, and make sure to check with them as well.

SUCKS! Since your apt. insurance has to pay for it just ask around for the best shop regardless of price! Your dealer's maintenance department is a good place to start!

Thanks for the replies everyone.

I think it should be easy to show that the structure wasn't designed to hold a significant amount of snow. My insurance company said I'm covered if the apartment insirance doesn't come through for some reason. I just want my car to be okay again

There is nothing for you to prove, the insurance must pay regardless. Call them to make a claim now. Your car should be in the shop tomorrow on their ticket!

Well actually it may not have been thier neglegence but thier property ins should pay. For example a familly member or mine had a big brach blow against the car, they claimed it under thier homeowners insurance.
