No, on the williamsburg bridge, 2 very very small lanes. enough for regular cars to squeeze by and this stupid cement truck comes up from behind and tries to squeeze in on the left hand side. There is no clearance for him. He smashes my mirror and somehow my car gets stuck on his truck. I am honking at him and he does not stop, he continues to go disregarding the honks and what you see is the result.

I thank God you're OK... there were 2 fatal accidents here in the Houston area involving cement trucks last year... whole drivers side torn off during the side swipe... I think most of them drive like idiots!!!

Thanks everyone… I am glad I am okay as well! The guys at the body shop said it's not totaled and can be repaired. How do you know if it is totaled or not? Should I argue it? I am not sure exactly it is determined.
Lusid: It is up to the insurance company, the driver tried to scare me saying if we call the cops, they would take 2-3 hours to come. I stood my ground and they came in less than 10 minutes. With how much damage there is, there is no way I would have just walked off, it is not as simple as replacing a bumper after a love tap.
Shtewps: yeah… the guys at the body shop say the whole quarter panel needs to come out and cut from the middle. Is that okay? Would that have any impact on the structural integrity of the car?
NCTL05: The driver was not remorseful and tried to blame me for it until I started arguing with him. He then realized his position started calling his boss or something. I am not sure about the damage; however, the back right tire looked like it wanted to pop off when the car was pinned.

I have two suggestions for you my friend.
#1 Since you car will be under the knife for awhile I would demand the nicest luxury loaner that is available. Just tell them that your job requires that you maintain a proffesional look for your clients and that this was one big reason you got a TL in the first place. I would not accept a Ford Taurus or a Dodge Intrepid if this happened to me. It might take them a month to fix your car. There is no reason you should have to roll like a hobo when you normally drive a car worth three times as much. Their insurance is paying for it so I say screw 'em!
#2 After the car is fixed I would seriously consider trading in the car. IMO I couldn't drive it knowing that happened and your car will never feel the same. Also you can be assured that this damage will turn up on a carfax and lower the value of the car for any future trade in's and so forth. It usually takes carfax 1-2 months after the accident to report the damage so you have that window of opportunity to trade it in before it shows up in the Carfax. Take it to the stealership and trade it in for a newer TL or Type-S and they should still give you the full trade in value. That's what I would do, but you didn't hear this from me.

I got the number of the adjuster and I believe he's going Friday. I am going to call him tomorrow and let him know the damages. I will def be reporting the suspension. I did not have any vibrations what so ever when driving the car, even going 100mph+, I sometimes catch myself with my foot feathered on the gas and not realize I am already doing 90 when I'm driving home an empty freeway at night

My insurance policy covers $60/day, I'm in a 2010 Jeep grand cherokee. Its the best car they had and it still sucks. The acceleration is horrible. Unfortunately I do not want to trade the car in and I plan on keeping it and I still owe a couple G's since I got it used. I wasn't planning on getting anything new until I finished school. I do not want to go, get a new car and have the remaining balance carry over as equity. Only way I am getting another car is if they total this one, which I doubt... but you never know.

Sorry about the accident. Good for you with your attitude on keeping the car. Everybody says they don't want it anymore after an accident. Just make sure it gets repaired well and take it back until you are satisfied.
Work everything through your insurance company. Let them talk to the op's representative. Your people should have your back, that's what you pay them for. Usually if you go to one of your insurers recommended shops, the repairs are guaranteed as long as you own the car. If you have questions, post here.

It will bondo right out!jk
Yea its not too bad. Definitely sucks that it hit the quarter panel though. Happy to see the TL hold up relatively well considering the hit and looks like someone would of been able to avoid serious damage if they were sitting on that side in the rear. Good luck with repairs though i hate repairs.

I called the insurance company and let them know my concern. I honestly did not predict the car would be as bad as it is. The guys at the shop told me there is suspension problems, etc. I am having them send over the damages to the car etc so I can take a closer look. I don't think it’s fair that my peace of mind and the safety of the car should be compromised based on the fact that the other driver was careless, negligent and incompetent and now my safely and peace of mind are at stake.

To total a car, depending on state and insurance company, you would have to have more then 1/2 to 2/3 the value of the car in repair work. Depending on year and mileage, you may be close to that. I would fight it out with your insurance since they will be the ones going to bat for you against the driver and company of the cement truck.
That is some serious repair work. Once done, you wouldn't be able to tell that it was fixed. They will cut the rear quarter panel off and weld a new section back in. The door will also be replaced. Suspension would worry me, if the sheet metal body mounts were torn, I would serious be concerned about that all being lined back up.
Talk to you insurance company and voice your concerns. What ever they pay out, they are going to get back from the insurance of the cement company. Insurance will always try to settle for as little as possible even though they are "on your side".
Good luck!
