This is Bulls**t!!

Ok, so last Sunday I was taking my kids out to breakfast and meeting some friends there. I turn into the parking lot and notice this Hummer behind me, so I am waiting for this particular parking spot to open up and this woman in this Hummer is getting impatient and I can see her getting pissed. The timeline here is about 1 min of waiting for this spot. So she decides to go past me and does so extremely close. At the last min she cuts the wheel and hits my TL. Ruins the driver's side fender, bumper, headlight, and wheel. So she says she didn't hit me bla bla bla. Long story short, she finds out I have my kids in the back seat and feels bad, starts crying the whole 9 yards. So he gives me her driver's lic. and I write down that info and she gives me another piece of paper with her most recent adress, but gives me the wrong insurance info. So I go past her house and see her Hummer sitting there so the adress is correct but no ins. info. My insurance company says if we can't get her info I will have to file a claim and pay my deductable, which I don't want to do. So I am relying on her to call my agent with the proper information. If that dosen't work my insurance company will go after her for all the money. This sucks, my car is pulling to the right BADLY. Does anyone know of any way I can "dig up" this insurance info or have nay good advice? Thanks everyone!

i know its a dickie call, but you should have call the cops to make a report. knowing what she tried to pull already i am sure her story would change again when she gets home and thinks about it. if you had a police report, you would have her by the short hairs.

I just went through this. My neigbor's kid rolled his skateboard out in front of my car as I was driving home. I never saw it. I hit it with the right front tire and it kicked up and dented my car. His dad was right there and saw it happen and the damage. He gave me his information...but not his insurance. I tried to be a good neighbor and did not call the police. I should have. I called him a couple of days later and he said he wasn't going to pay since there was no criminal liability involved. I told him that may be true...but there sure was civil liability and I would pursue this that way in small claims. The next thing I knew, his insurance adjuster called me at the office offering to fix the car. I told him I was surprised because the last I heard he wasn't going to pay. The adjuster told me that he checked with his company lawyers about my claim of civil liability and they told him I was right...and that he would also be responsible for all legal fees, time missed from work, etc etc.


still, I should have called the police.

I would call her and ask for her insurance information. If your state requires proof of insurance to get plates, I would check that source too.

Have to call the police. That is usually the only way you will be able to get the insurance info from the person.

That's the other problem I left out. I called the police as soon as it happned and they came out but said no report could be filed since it was private property (resturant parking lot)

Either get a friend who is a lawyer to draft a letter on their letterhead asking for the correct insurance info, or go by her house and ask her again.

Yep. Cops will not take a report on private property unless someone was injured.
Maybe the restaurant has a security camera that shows the accident? Just good to have in case the story changes. The lady that rear ended my wife changed her story but luckily her story unraveled when analyzed.

SO IF SOMEONE GETS SHOT IN PRIVATE PROPERTY THEY WONT DO ANYTHING? THAT MAKES PERFECT SENSE.

this is not 100% correct. I bet it depends on the state. I live in GA and had a police report filed (no injuries/ tickets issued though) for an accident in a gas station parking lot where I was backing up and a girl pulled up behind me. I kissed her bumper at 1mph. It scraped a tiny square of paint of her already thrashed miata. She was furious and yelling about how I better have insurance even though she didn't, all while her drunk passenger admitted to my wife that the driver's boyfriend wrecked the car last week :p

the cop showed up, told me he could give me a ticket for improper back up (wrong) and could have given the girl a ticket for no insurance (correct) but didn't. Either way, he made a report, she pulled it and filed my insurance company for 200 bucks to repaint the bumper. The insurance company just laughed and said ''we'll pay this and make it go away'' lol

You are correct, It is state dependent. California (at least southern California) police tend to not do anything with non-injury car accidents on private propery.

Sometimes they try to not do reports on more serious crimes as well. For example, someone threw an object at my friends car while he was driving one day. He called the police and they told him they will not come out or do a report. He reminded the dispatcher that throwing an object at a moving vehicle in California (no matter what it is) is a felony. The dispatcher promptly sent a police car to take a report.

No, robbery is criminal. If there was no injury with the car accident, I don't think that violates any criminal statute (I'm assuming it doesn't) as the main purpose of his inquiry was for a civil compensation.

Sorry to hear about your car. You can't trust anyone these days.....

Off subject.............I had a stupid WOMAN backed her car from her house into my fence. I waited a few days for her to confront but she never did. I called the police and they couldn't file a report because it's private property. I took pics of her dirty Accord and seen all big scratches. The husband offered to replace the part of the fence, but he never did. I had to do it myself. I hated them so much, and that's why I moved.

This is real BS as the title of the thread states. I know that they have laws to follow but dang what kind of crap is that? Couldn't they at least just force the person to give the insurance info by just standing there and asking them to provide the info without filing a report?

Talk about a big let down. Now I know what to expect if I ever run into a smiliar situation in VA.

They typically won't do a report anywhere unless someone is bleeding. They just don't care about property damage in an accident.

Being robbed is a CRIME... hitting his car is a civil action... he can SUE her and will more than likely WIN...

That is intentional property damage... and maybe they could charge you with assult if she was in the car... so you go to jail and she can sue for all her broken windows. Yes, you will get your money for the fender... but who cares by then...

The lesson, ladies and gents is to say that your neck hurts at the time of the accident. The claim, is not to defraud insurance , it is merely to have a law enforcement officer make a report that then can be used for your convenience.
In other words, the idea is to get a report to help you with any legal problems you may encounter after the fact and NOT to engage in insurance fraud.

I know it sounds like a low impact accident but who is the officer to say that you WEREN'T hurt. I also know that it is 15 minutes out of a busy officers day, but trust me, if they have to respond to a real emergency they will tell you to come to the station to pick the report up, and they will respond where they are needed.

Sounds like the only way to go nowadays, as sad as that is.

Perhaps the lady was unstable when she gave you her insurance info if she was bawling. Try calling her to get the info

I wouldn't encourage that. We already have enough people collecting disability when they are perfectly able to work. And WE ALL pay for them to sit at home, and watch Oprah.

Read before you respond. I said to facilitate an accident report it makes sense to tell the officer that your neck, head, or whatever hurts. I said that this is in no way telling anyone to defraud an insurance company!!!

What is the matter with people? You hit someones car you get out and give them the correct information. I cant stand people that try to get out of something they did wrong that causes problems for someone else. The first thing I would do is apologize to no end and hand over my insurance info. I would feel terrible

RV - limit your stress and file with your insurance company. They should pay for your repairs and go after the at fault driver for their payment and your deductible. If she has insurance, that's probably the easiest way to have her provide the information.

I haven't read all of the responses, so excuse me if I'm repeating anything anyone already said. It's not too late to call the police. If you're in California (and most other states have similar laws) and you don't have insurance, you lose your license AND your car. If she wasn't properly licensed, I'd say stick it to her and make her pay dearly. That's the cost of driving with bad or the wrong insurance information. And if she hit you and kept going, that's technically a hit and run. Felony!

As far as your insurance, do you have uninsured motorist coverage? If you do, the insurance company will waive your deductible if you're hit by someone without insurance. It's not too much to add it to your policy and it can be a REAL saving grace if someone hits you without insurance.

If you file an uninsured motorist claim, your insurance company will probably perform an asset check on the liable person to determine if the person is, indeed, uninsured or simply trying to hide his/her insurance information from you.

sounds too familiar.

I was driving on a three lane street the day before Thanksgiving and this lady in a Toureg tried to make an illegal right turn from lane two while I was on lane three and put a big dent in my quarter panel. Cost to repair is over 4k. She came out of the vehicle, admitted she is at fault and gave me all the information I needed from her. I was in a rush because I had to meet a client so I didn't get a police report although a cop did pull over, ask if everything was okay and since we swapped info already, the cop carried on.

Next thing I know, I reported it to my insurance company (21st) and everything seemed oaky. A few days after, her AAA insurance called me saying she is denying liability. Now my adjuster says thats BS and that its going to arbitration.

What a bi***. I don't know why people are so irresponsible. I will make sure I get a police report no matter what next time!

Now I'm shopping for a TL-S. We'll see how that goes. Any advice will help
