They all (including KTuner) put a disclaimer that the use of their tunes is for “off-road use only” to CYA, but what the consumer does is another story, and since their tune doesn’t alter the emissions system, it is likely undetectable in most state’s emissions testing regimen. While my RDX is too new to require testing in AZ, I have taken tuned vehicles in and they have plugged the OBD sensor in and I passed with “flying colors”, whatever those are....
