i had a hole in my sub frame floor that was damaged due to driving over a boulder the size of a soccer ball. my insurance said even though the repair shop can repair it, they felt that it was unsafe to drive.

i guess you cant get a second opinion on that frame to get it totaled. isnt there like some sort of limit where insurance claims it a total loss based on cumulative damage. that shit is about $13k+ in damages.

Ugh seriously not totaled? Did you tell your insurance company that you JUST got it back from the previous accident?

How's your head? Last time you said you had a huge migraine and some neck issues right? Everything check out okay? Remember to spare no expense to make sure your health is fine. The other person's insurance company is gonna cover everything.

My head is fine luckily. My neck is still stiff but I started seeing a chiropractor and I'm gonna keep going and make sure they pay! I told the insurance adjuster about the previous accident and he just kind of brushed it off, should I call my own insurance company and get advice? at this point I just want the car to go away lol

sounds shady. maybe the other insurance doesnt want to total it because it cost too much?

ya talk to your own insurance about why this car isnt totaled. tell them you feel the car is unsafe because of the frame damage.

Hey, my advise is to see a lawer before you sign the authorization for repair. That way you will have all angles covered before making any desitions.

$7k on a $30k car is not even a third, they won't total it. The other incident has no bearing on this one, 2 different companies. I'd take it to Carmax for an evaluation. Also, on both cases you need to investigate diminished value since your car is pretty new. Good luck and feel better!

All things considered, it sounds like your insurance company sucks...

2 Frame-related accidents and not even consideration for totalling out, plus you've technically incurred some injuries? Man...

shouldve been totaled on the 1st one. 2nd one i would be skeptical on why it wasnt totaled.

again. something is fishy. its definitely not her cooter between her legs. although hers probably smells hella good though. hahahaha

^ Hahahaha oooh nice pic.

But like Ressling said your insurance company sucks. Though I've heard of people damaging the frame of their car and insurance didn't total it out. Back in high school I had a friend whose girlfriend ran her 03-05 (can't remember the yr exactly) civic coupe HEAD on right into a ditch. Basically speeding down a straight road and it came to a stop perpendicularly to another road and there's no way you can make a 90° turn so she flew and BAM! bent the frame right smack dead in the middle of the car. She was fine and they "fixed" the frame, but I was pretty much sure she'd have alignment issues down the road. But ironically it wasn't totalled... go figure. And your car was hella raped in the back. I still say they should total it out. If your not upside down I say trade it for another TSX. <--- that's goin to be pretty hard not to be since you've been in a wreck. But check around an see whats up with the car's frame and like others have said check carmax, they may take it for a good price. Or try another dealer. I hope it all works out for you.

BTW I also had another friend in high school run his 94 civic sedan into a ditch too! lol that story is for another time.

If the vehicle's frame is kinked they usually won't repair it, but if it's swayed or just the rails are bent they will. Insurance companies are funny with recoverable vs. non-recoverable (at fault) incidents too. If they can recover something, they may be more apt to total vs. a one-car accident where there's no recovery potential.

You could always sell your car at auction, collect your money from insurance, and put that money towards a new TSX. Not the best solutions, but it is one option...

Not an expert when it comes to these things but have had a few accidents in the last two years so kinda became aware of the insurance mumbo-jumbo.

If there is no frame related damage to the car, most insurance companies usually total a car when the repairs exceed 75-80% of the NADA value of the vehicle. This also depends whether they can recover the money from the party at fault. My last car was hit by garbage truck and repairs exceeded 80% value of the car but insurance co fixed since NJ State vehicles are exempt for paying any related damages.

If the damage is largely cosmetic, I would say fix it and keep the car for a while. Your resale value will definitely take a hit but you can claim diminished value from both the accidents. You can offset the decrease in value by how long you keep the car. I too got into an accident recently with no fault of mine and went through the same set of things. If you need contact info for a diminished value firm, hit me up. They deal and settle with the insurance company and think charge 30% of the proceeds.

All the lawyers I spoke to told me diminished value claims are very difficult to prove in va. I'm still waiting to try for it from my accident in February. Geico has been in no rush to settle my claim.

OP, glad you are feeling mostly better. Hope things work out for you.
