Passenger Seat Rubs against console !!

Hi , I have a 05 TL , The Passenger seat rubs up against the console , Its so tight that it makes rubbing noise when trying to adjust it back and fourth .

Has anyone else had this problem , The Anchorage dealer says its within specs !!

I don't believe them , Please help and advise , before I sue them !!
