He's lucky he was only doing 70. A 5->2 downshift much faster may have been forceful enough to fling the unrestrained 2-year-old against interior panels of the TL, or worse, through the windshield.
What's wrong with people today? Restraints are there for a reason!

its not that u guyz, i mean, i didnt have his car seat and my sister had him buckled up with her, and i had to go to temple, my mom also has a 2002 325i and the cars brakes were almost gone and i had gotten my brakes replaced the day before, other wise we would have takin the beamer, but i was talkin to someone and he said that i should just tell the dealer to give me a new car because mine is faulty, can i do that, pay or not pay the diff and get an 05 tl? i have an 03 tl now
Lots of people do that kind of stuff, and I didn't mean to be harsh. Let this incident make you realize that you can't do that. Think about the force of your sister's weight against the little boy against the seatbelt in the event of an accident. It would not be pretty.
Just be careful with the little guy... if that situation arises again, suggest someone stay behind and always use a car seat. I know you wouldn't want anything to happen to any of the people you had in your car.
But about getting them to give you a new car, probably not. They'll just replace your transmission and send you on your way most likely. What are the miles like on your 2003?

Irresponsible and pathetic. I think we'll close this thread before it starts getting real ugly.
