ticket is on the driver

When you get a ticket it is on YOU, the driver, not the car. The car info is put down to document the entire situation and location, etc. Even if the ticket is hand-written with your wrong name spelling, or perhaps your license number is off slightly, it doesn't matter. The info gets entered in the system correctly, and you get the ticket.

If you go to court and argue they mispelled your name (this has happened to me), they may get pissed at you and make the fine stick for sure.

Good luck, and I hope the fine was not too high (damn tickets!!!). My worst was 39 over the limit, but I got off at court, and have not gotten caught since (I also drive a bit slower now )

What do you mean there is no more Off Topic? Anyway, isn't there a way that you can ask for all the documents varifying that the equipment in the cruiser was legal and calibrated and you don't have to show up to court unless you receive all those documents. I'm not sure about it but you should look into it.

We don't get that kind of treatment in NY. Basically it comes down to the cop, if he is cool then he won't make a big deal. If he is an a$$ then get a good lawyer to bust his balls. There are a lot of things you can catch a cop on. I know this woman whose husband is a divorce lawyer (doesn't matter if divorce or not but he knows the law), he was issued a red light ticket where he was guilty but decided to fight it anyway. Even though he was found guilty, he was busting the cops balls that everyone in the audience clapped when he was through with the cop.

WishingTypeS, where did this happen in NY?

I'm from NY also. I have heard of people requiring the calibration documentation before court.

Regardless of whether or not the info on the ticket may be correct, one factor which may or make this issue moot is...

You signed the ticket, didn't you?

It can be argued that trivial inaccuracies such as car color or misspells shouldn't matter at all since obviously you must have been there to have signed the ticket...or are you a) gonna say that it was someone else who forged your signature at that particular moment; or b) admit to signing the ticket for someone else's car?

Try postponing the date that you appear in court but do this a few days before your due to show up. Hopefully the pig will forget and it postpones. And is you have some luck he won't show up. This is what I did and I won.

I received thjis in an email, It might help!

WHAT TO DO IF YOU GET A TRAFFIC TICKET:
This system has been tried and it works in every state. If you get a speeding ticket or went through a red light or whatever the case may be, and you're going to get points on your license. This is a method to ensure that you DO NOT get the points. When you get your fine, send in a check to pay for it. If the fine is say, $79.00 make the check out for $82.00 or some small amount over the fine. The system will then have to send you back a check for the difference, however here is the trick. DO NOT CASH THE REFUND CHECK Throw it away! Points are not assessed to your license until all financial transactions are complete. If you do not cash the check, then the transactions are NOT complete. The system has received its money and is satisfied and will no longer bother you. This information comes from an unmentionable computer company that sets up the standard databases used by every state. Send this to everyone you know. You never know when they may need a break.

NO! This does not WORK!
Do not attempt this!

If you are going w/out a lawyer then like TLNY said, change the court date a few days before the court. 85 in a 50 is a tough one. How old are you, how is your record?

A couple of my co-workers have done this, and it worked for them. They both live in PA. If you're called to court, I'm sure it'd be a little more complicated.
