My poor TL
The other night I recieved a call from my x-girlfriend and she told me that some guy was trying to rape her. She had some how managed to get away from him and lock herself in the bathroom and called me. Over the phone I could hear the guy yelling and banging on the bathroom door. I figured that I would get there long befor the cops would and my ex said she would rather not get the cops envolved sence she had not yet been raped. So I raced over 2 her place in my beloved TL to stop him. When I got to her place, the guy and I got into a fight and he lost. Near the end of the fight I ducked a swing to my face and he broke his fist on the brick wall behind me. I went inside to check on my ex for five minutes and when I came out I could not believe what had happened to my TL. The entire car had been scrached from top to bottem and he broke off the mirrors. There is not a square foot on my car that did not get scratched. THAT IS WHEN THE COPS GOT ENVOLVED. After talking to the cops for a long time they explained to me that is was inlikely that the guy was going to have to pay for the damages because there was no witness for him doing it.::wow: I took my TL to the shop the next day and was told that the whole car needs to be repainted. A $3250 job!

Well I can tell you, $3250 will not even come close the cost of a totally new paint job. This has been discussed many times before on this board and the consensus is it's more like $6000 - $7000 for a total repaint.
Think about it, you need to paint every part of the car, door jams, trunk, under the hood....... Not cheap my fiend.

Have her get the police involved. He, although may not have battered her, definitely did assault her. And SHE is a witness. I wouldn't wait to long to report it because it will look suspicious. But if it is a recent incident (2-3 days) then SHE should really report it (his actions toward her). You and her will not look like wussies because you are both in the right and this "some guy" is in the wrong.
Although the issue with your car might not be involved it should solve the primary issue (your x).
I really hate to see this sh!t happen. Sucks to be you dude, I hope it all works out.

I want to beat the guy down again, but nothing worth going to jail over and putting a$$ in danger. I well not foget about this and I well get even some how. I have talked to the cops and the D.A. about this issue and because the way things happened they can not help much. They pretty much told me that I was on my own. Yet another reason why I dont like most cops.

how are you on your own when this guy f-ed up your car, right after he was about to rape your X. your X is your witness so use her in your report and tell the cops that she saw everything, even when the guy messed up your car. he cant get away with it, do whatever you can.

No one was outside when he was scratching my car and nobody actually saw him doing it. it was 3:00 in the morning. I told the cops everything and still they wont do sh!t.

Good luck prosecuting: no witnesses to the crime, only a suspect with a motive. I suggest you think long and hard about retalliating - not only is it completely wrong but you could get busted. He also could retalliate worse against you, what are you [prepared to do fight to the death? Crazy.
Do you not have insurance on your car? If so then only deductible to get it fixed.
On the up side your ex is more or less okay and so are you. I would try to get her to prosecute the guy for assulting her else he may try it again om her or someone else.

I am more pi$$ed off about what the guy did and was going to do to my ex then what happened to my car. After all, a car is a material item, it can be replaced. I'm just being screwed over on getting it fixed. I do have insurance, but my deductable in $1000. That is alot of money for me. I'm really frusterated with that cops and the way they are treating me. They dont want to help me out. :yack: Boca Raton cops!

Talk to a lawyer.. Dont take legal advice from us and dont do anything in a instant.. stay calm, chill, think and go to a lawyer.. Dont do something you will really regret later... Doesnt your Ex have any parents that can help you out, or better yet your own parents? How old are you?

I'm not sure about Florida, but in NY you can still take him to civil court for the money, the police can't arrest him without the witness, but you still have a very good chance of winning in civil court. Actually even if you did see him the cops could still just take legal action, but the judge still might not make him pay full restitution, legally there are two different courts to go through for full justice, one for punitive damage (civil) and one for specific service, jail time probation whatever. But civil court is a lot easier than criminal, just look at OJ. so what im trying to say is sue him.

B) She should get a restraining order A.S.A.P. on the guy. (Does she know the doode? Is he in the same area where she resides?
C) Broken hand against the brick wall? Is that a fact? If so, do you know the person? Where drugs involved? Broken hands are a lot of pain... to break off mirrors, and scratch a car takes time and strength... If this happened while you were inside, he must of had an accomplice. Again, I was not there and don't know from your short story what really happened, But I suggest she get a restraining order on him... if they (F.B.R., Fl cops) are going to take him in, that and a handy cell phone almost always do the trick.

Was there any blood on your car? Because if he broke his hand on the brick, Im pretty sure it bled and than you said he scratched your car so there should be some blood somewhere..

You know, he does have two hands. It could be possible he used the other hand to do all that sh!t to my car. And no, there was no blood on my car, I wish there was. The cops did find a smudged finger print though. They are seeing if they can use it to connect him to the damage. The cops also took the flashlight that he used to scratch my car as evidance.

And with something this traumatic (a friend nearly getting raped and someone trashing your ride should be pretty traumatic), why are you consistantly trying to get everyone to check out your car and advise you on what to mod next? Just worry about getting your car fixed if it is indeed messed up.
