I look at it this way: If ever there was any dealership to be at when this happened to you car, PAA was it. It definitely sucks for them, but seeing as how good their customer service has been, I'm sure Wayne will make sure that CarFreak is appropriately taken care of. Meaning, he will follow through to make sure this is resolved to CF's satisfaction. If the car needs to be totalled, I'm sure he can help push in that direction. If it can be fixed, they're the ones you'd want to have do it. They'll get it right, no matter how it works out.

Here's hoping PAA is up and running 100% again soon and they catch the ba$tards responsible and force them to drive Daewoos for the rest of their natural lives.....

Park Ave's adjuster didnt come to see the car today. They have an appointment to come tomorrow morning. Their insurance adjuster stated that I need to call my insurance and get an adjuster to look at my car. I hope that I don't have to file another claim!!!!!!!!!
I wonder that the fact my car was inside their garage makes this situation different. I am very hesitant to claim my car to my insurance company because it would be another claim and therefore I would be dropped from my policy (this would be the 3rd claim). It only makes sense to me that Park Ave's insurance company should be responsible. It was in their hands and it was left there becuase the car needed parts that needed to be ordered. This is such a mess!!!!!

i totally agree with BLEXV6, i cant see how park ave acura would be liable for damage to the car. Carfreak im sorry to hear about your insurance if you gotta make another claim, what company do you have? I wouldnt see that they would drop you because of 3 claims unless all of them are in the last month and all of them are your fault.

i also agree with pianoman41, if any of us would have problems we would want this to happen at park ave acura. I'm sure wayne will do all that he could to help you out.

Exactly what i was thinking, its like if you had 3 car accidents and all of them were the other parties fault, i dont see why your insurance would drop YOU.

As for the dealership, arent they responsible for your can when its in THEIR hands? Just doesn't make sense to me. Even if wasnt Park Ave fault, wouldnt their insurance cover it?

Its like if someone left their car with me in my garage, and my garage caught on fire.. wouldnt my home owners insurance cover his car? Damn I wish i knew more about insurance companies!!

I would be scared to leave my car anywhere now. I would think the dealership is the safest place, and INSIDE the dealership even safer! Was there no alarm at the dealership?
WHAT A MESS! Ben, i really hope you dont get screwed over on this, and like everyone else said, im sure Wayne will take care of you.

Wayne any ideas over the whole thing? I would love to educate myself.

I believe it would be there fault if they did something wrong. If they were driving the car and it was damaged while one of their workers was driving it, then i would say they are responsible. But in this case i dont think they are liable for anything, especially if this is a arson case like wayne was talking about.

I hate to bring this to your attention, but if PAA ISN'T reponsible and you do have to claim it under your insurance....

does your insurance cover ARSON?

I don't know if that's covered... you need to check on that.

I hope things turn out ok for you.

Believe me guys- I'm doing everything I can to make this turn out ok. It really is up to the insurance companies- we have to go with what they decide. I must have made 100 phone calls to move this along- Nj insurance is just a mess as many of you know. from what I hear so far- your own insurance is responsible for your car. Given the curcumstances here- maybe its different- I'm trying to find out. We are all working our butts off on all aspects of this fire thing- electricians, door company, car wash company, cleaning company, tile company, painting company, insurance investigators, police investigators, rescheduling customers and least of all Christmas Week! Whew!!! Our prime concern is the quality of service we are able to provide our clients and we are doing all we can to work this out. My entire stafff is devastated over the loss for our customers sake as well as thier own!

Thanks again to all for your support and lets hope this works out great for Benny!

You will not have a problem with coverage as a result of arson, as fire is the most basic coverage. That is of course assuming you did not do it. If you did, intentional acts of an insured are not covered.

Actually this can and does happen. The fact that you are involved in multiple claims places you at a higher risk than someone who wasnt involved in any accidents, which puts you in a higher risk category.

If your insurance company has to pay money to fix your car if it stolen or hit by an uninsured driver(all not your fault) the fact they paid can raise your premiums.
