Just got my S about a month ago yesterday I was driven home from work and the dam arm rest popped up on its on. I no this is a known issue, so those of you that have had the same problem what should I do.

I have the same problem, and so do quite a few others here. Take it to your dealer.

 

You're not the first. Just go to the dealer and tell them to fix or replace it. Why would you even want to consider doing anything else? The car is brand new.
