Some users are left stranded like cheerios in a bowl clinging together, this forum is probably the last link to communicating refunds/status to each other. If it must not be here then I guess it's not my decision but I am sure this is helpful to the users who we call friends here who are stranded.

Well i was going to buy something from Xephyr but then I changed my mind and got a deal on the AEM CAI. I did order the Xephyr and I was promised that it would come in 3 days, but then he never went by his word. But I did receive a refund but that was a while back. Sorry to hear you guys waiting for your money. I think all you have to do is mention the word lawyer, maybe something will happen by then.

I have spoken to Fotis over this a few times. He is concerned and is (i believe) not very happy that chris is reading this and doing nothing. I cannot say he is as pissed as me but I know not all is well in Minnesota.

I am disappointed just as the rest of you that Chris is not being a stand up bisunessman. I am still hoping for the best of course, meaning that he will come through with a valuable explanation to this mess. I am however not clear how this mess started, anyone willing to fill me in, eclipse, goldtypes?

Oh, I am familiar with all of this that has been said regarding you are not getting money back, and etc. I am still not clear what issue Soopa has with Chris and why eclipse decided to write that post. I was under the impression that eclipse was a big supporter and kept in touch with Chris, but I am not sure that the post is clear on why eclipse felt that situation has gotten out of hand. Is just because we have not heard anything from him for some time now?

This posting should not be construed as legal advise.

That being said, if you've been getting the run-around and the "check is in the mail" story, or even worse if he's just avoiding you, then you may want to consider filing a small claims suit against this guy.

It's never a good sign when people treat their customers like this, and often it results in the guy just closing up shop and going out of business without any consideration of the people that have outstanding claims.

If he can't provide a reasonable excuse (in my book there's no excuse for not giving money back on demand when the products have not been shipped) or is avoiding contact, then you may want to go ahead and get a judgment filed in small claims court. This way the court can declare that he owes you the money and that it must be paid. Different counties have various ways of fulfilling judgments. Many counties require you to file in the county where the defendant lives. I'm sure you could find an attorney who would give you guys a good rate to make a filing for each of you.

Bottom line is that you have rights that are protected by law when it comes to consumer relationships (read up on consumer law and you'll be suprised). The laws are there to protect you, but you must have take the first step and get the ball rolling. If this guy refuses to give you a straight answer and avoids contact, you're not stuck like you may be led to believe.

I was one of the first 3 people to order a Xypher CAI and he basically did the same thing to me as far as not shipping the product on time and not contacting me with info. I tracked his ass down to his work and finnaly got him on the phone. For the people that want to get in contact with him, shoot me an email and I will give you his work number.
