The page isn't loading for me, but... IF you TOOK the picture they're using, you can probably claim copyright infringement if you can prove you took it. Since you've not submitted anything to the Copyright people in the goverment (I'm guessing here), a legal case may not be easy though.
If it were me, I'd just politely give them a choice that they either give you credit for the photo/car, or stop using the picture. Whether you want to do this through a lawyer, it's up to you.

if they just took the picture off the web somewhere and used it without your consent they are ripping you off. every picture, once taken, is copyrighted by the person who took the picture. one doesn't need paper work submitted to any agency or anything to make it official. i'm sure a kind word will result in them removing the pic. i highly doubt you'd get any royalties from them. just i guess here, but i suppose you do have legal grounds to sue though because they are using your image for a commercial purpose.

SUE THEM OR DEMAND TO GET A SWEET SET OF SILVER OR CHROME 19x8 or 20x something or a bigger size and put them on the car, on a SUV, or sell them and get some extra loot for your car. That's just wrong, they should have asked for permission. I believe that's invasion of privacy or something. I would be flattered as well, but forget that, get something out of it cause they are getting a lot of good use of your car enticing other people who see the website to get those style rims cause of how hot it looks on the car!

In order to sue for copyright infringement you would need to obtain copyright registration of the photograph through the office in DC. This is easily accomplished. The fact that it has not been registered prior to infringement means that you will not be entitled to the recovery of your attorney fees and would not be eligible for statutory damages. You can bring a suit while the registration is pending, but it is possible that the suit will be dismissed prior to your receipt of the registration number. Note the picture of the car must be your own to sue under copyright infringment. If you do not like the photo on the site - you can call them and they will likely take it off.

I think its kinda cool....plus...If I said anything, they'd just yank the pic. I know one thing is for sure....they wouldn't give me anything....maybe a sticker...for the use of the pic.
