seatbelt ticket
If the driver has seat belt on, but the passenger does not. Will the driver get the ticket because passenger is not wearing seat belt??

I believe it depends on state law - but in many states if the passenger is over the age of 16, then THEY are responsible for their seatbelt and is the one who's ticketed if the car is pulled over.
If the passenger is under the age of 16, then the driver is responsible for making sure they are buckled in.
If the passenger is under the age of 16, then the driver is responsible for making sure they are buckled in.

I thought it was if the passenger is under 18 it is the drivers fault and they get the ticket. If the passenger is over 18 then they get the ticket. That is supposed to be the case in NJ.

My car doesn’t MOVE unless everyone is belted in.
Had one wise ass “friend of a friend” passenger who thought it would be funny to unhook his belt after I was on the Interstate and up to speed.
Once I was sure traffic was clear behind me I did a simulated panic stop from 80 to zero and he almost went through the windshield.
The fuker put his belt on after that and knew not to kid around with me anymore.

It is not a ticket for a car. You can get a jaywalking ticket or any other number of tickets from a cop that have nothing to do with your Drivers License

I was pulled over for my passenger not having his seat belt on once. The cop asked if my passenger was older then 16. I said yup. Then he asked me who I should give the ticket to, me or him. Guess what I chose?

Lets say the passenger is over 18 or even over 21?
I dont think a police can hold the driver liable for a passenger who is over a legal age. I could argue that my passenger refused to fasten his seat belt...
Anyone knows for sure how is it in NJ?

Why wouldn't the passenger put on the seatbelt. I've left a friend 45 miles away from home b/c he refused to buckleup, so I kicked him out of my car, he took a greyhound home. That shit doesn't fly in MY car,.

NJ is a primary offense, so you can be pulled over for no other reason. And anyone over 18 as a passenger gets the ticket if they do not wear a seatbelt.
On my trip to Wyoming, once I got to Nebraska I didn't wear a seatbelt, while driving or as a passenger. I wore one 3hrs at the most the entire week long trip. I know it is stupid, and I'd never do that in NJ, but in the middle of nowhere I didn't mind.

I know in NY they changed the law, wen i took my defensive driving class the guy was saying that, if the passenger is over 18 the passenger will get the ticket, if he/she is under 18, the driver will have to pay...

I don't feel comfortable unless I'm wearing the seatbelt. And I'm the same way as Shawn S. I don't move until everybody is buckled in. First off, I don't want to get a ticket (In Michigan, I'm pretty sure that the driver always gets the ticket, because he/she is responsible for the vehicle and its occupants). Second of all, if anybody is in my car, chances are that they are people I care about. I strictly enforce my seatbelt rule especially if it's family or friends. There is NO reason why you should not want to wear a seatbelt. It saves lives.

I agree with Shawn, my car doen't move until everyone has their seatbelt on. Regardless of who gets the ticket, it is the driver's responsiblity to make sure everyone has their belt on.
How would you feel, if you had an accident and one of your family or freinds was killed only because they were not wearing a seatbelt. Wearing a seatbelt is the easiest thing you can do to protect you and everyone else in an accident.
Also if you have someone riding unbelted and you have an accident they become a flying object and could injure or kill someone else in the vehicle.
Remember Princess Di, she would have still been alive if she had been wearing her seatbelt.
