Racing warning for NYC

Driving down StatenIsland expressway I catch up to CLK-320. As soon as I am next to him, he accelerates a little(just enough to be a car length in front and resumes normal speed). So of course I take it as a challenge and pass him accelerating like there is no tomorrow. Mercedes starts to accelerate with me, so I am thinking great finally somone who wants to race Two second later that MOFO turns on strobes, sirens, and his lights go into the police mode (alternating high/low beams). I am thinking screw you, there is not way in hell cops will drive a CLK-320. Boy was I wrong 2 miles later I get pulled over by a marked police car with 320 still on my ass. 4 cops get out (2 from CrownVic 2 from MB) and I had to talk to them for like an hour explaining that I thought that the guys in MB were just harassing me, and that I in no way was trying to run from the law. So now I have to appear in court Thats it the next time I race its going to be at the track

In case someone is interested here is a list of all NYPD undercover vehicles that I'be seen so far:
CrownVic, Caprice Classic, Mercedes S500, Mercedes E320, Lexus GS300/GS400/LS400, Lincoln Towncar, Yellowcabs, Ford Explorer, Jeep GrandCherokee and now to add to all of this CLK-320

DON'T RACE in StatenIsland!

That sucks I know the NJ Turnpike Authority has at least two Corvettes (White&Black) and a slew of Older Camaro Iroc-Z (hahahahaha) So morals of this story are
#1 Dont race on the streets at ridiculous speeds.

#2 Dont antagonize people that dont want to race as they may call the police from a cellular.

#3 If you're going to race on the highway/street use some level of judgement such that your not endangering everyone else out there too....

Everyone like to play a little cat&mouse (inclusive of me) but with the way that police are cracking down on "aggressive" driving ... save it for the track...

Just a guess, but if you get a Lawyer that specializes in this type of case you might be able to get off by proving that it was entrapment.
And hopefully you slowed down at the first sign of a MARKED car.

Not pulling over for a Mercedes with strobes is one thing, but running away at 100MPH might be harder to justify.

Dude, here's what you do. Go find some news articles of people being robbed/raped/killed by psychos in normal cars posing as undercover police officers. Many states have made it ILLEGAL for unmarked cars to pull people over PERIOD. Take these news stories to court with you, get a good lawyer, and tell the judge that in a millon years you would have never suspected that a MERCEDES BENZ that was harrassing you would have been a cop. And that when the lights came on you were convinced you were going to be the next victim of a psycho murder and that you were not going to pull over until you saw a MARKED CAR. Then clearly state that you pulled over and were completely cooperative when you saw said marked car. Say that you were scared shitless of this mercedes chasing YOU at over 100MPH and that you thought those moments might be your last on this earth and you were praying for a marked car to show up and end the nightmare.

If they still fuck you, get a really good lawyer and file a lawsuit against the state for emotional distress, assault, etc... No fucking way should an unmarked Mercedes-Benz be chasing someone at 100MPH down the highway.

You can't blame the police for being creative. I'm mean they didn't throw you to the ground and beat you.

I hope you were under 300 mph

Staten Island has a 98% conviction rate with traffic violations according to a recent newspaper article. This is the highest in the city and state. No excuses are accepted ya guilty, pay at the counter, have a nice day.

Last trip to Burlington, VT, The whole traffic was consitently some 65! A bit Later, I was driving behind a Nashua Police Motorcade. A show of force!. They even had a "Police Big Foot", a bomb-disposal towed thing, 4-6 bikers. The whole thing, I just drove behind those who are breaking the law driving 10-15 + over 55!

Yeah, They are previlged, right ? Just wanted to let the Judge know about how much Justice we have in US.

Technique:

In a "perfect" world, you would be right, but lets face it, the police are revenue collectors. Some of the best have been punished for trying to educate drivers, not fine them.

So, if I see a cruiser drive ahead at high speed (a common trick around here). Then, the traffic goes, "its safe... lets play follow the leader.." So, now there is a "clump" of cars running at 75-85. Surprise, a one or TWO CHP cruisers come from behind and nab 2-3 cars all at once.

The driving in the flow of traffic doesn't cut it, and the basic speed law comes in to effect.

Then the dreaded words, "Son, its your day for a ticket."

So, its not like the Mercedes tried to ram our fellow CL-S driver. The FBI used to have Grand Nationals, if they can drive around in them, the police can pick what ever they want. By being duly licensed, they are free to play by "their" rules.

If the pain is bad enough, it is worth getting an attorney to plead-out the case.

HOW fast was this ticket written for? Was evading thrown in?

Just remember who the polce answer to in the end, along with he judges. Don't think of the police as some invincible force, they do what we tell them to, that's it. One thing they fear most is publicity, they would love to push people around all day as long as no one else hears about it. I'm not sayoing all cops are dicks, but just one ruins a whole precinct. The "voters" will only put up with so much for so long, if the mayor , sheriff, judge, or anyother elected official gets the idea that a good number of "voters" are unhappy and they might lose their jobs--you can count on some major "reforms". you want to make a differece, find all the other poor schmucks around having similar experiences and go to a newspaper or publish your own flyer. If they get the idea that other people will see what they do, they will probably think twice before they do it again.

Also, there are a lot of people out there who probably don't like the idea of cops driving aound in Mercedes while there are so many underfunded city programs, schools, homeless and hungry--what do they need them for anyway?

Well for thing I did win, he did not catch up to me, 2 I almost ran away from a police cruiser too cuz I did not realize who the hell they were either They went easy with the ticket they gave me 40 over (basically for going 95 in a 55 zone) when in reality I should have been handcuffed for going 120+, but I guess my story that I did not realize why he was chasing me worked So I am going to court with this issue, wish me luck

Hey that sucks alot. A MB CLK320 as a cop thats crazy. I know down here in Miami they have a Viper or 2 that try to make you race. Watch out guys.

EricL, You are correct.. it is all about the revenue. If they didn't write tickets the tolls would be two or three times higher. If they didn't want us to speed they could have all cars regulated to 65 mph instead of 150.

Arik, I don't want to scare ya... But get a good lawyer, unfortunately I do not think it will help. Just be thankful that they did not take your car!!!! It is the law in NYC if you are going over 100mph they could take your car. Just like the prostitution law, if you get caught they keep your car.

NY law is not over 100mph, its twice the speed limit you get arested plain and simple. if the speed limit is 55 you can go as high as 109 (provided perfect calibration on the police radar and your speedometer ) and not get arrested, red ticket yes, arrested no.

There's a cop by me that uses a 5.0 Mustang as his patrol car. Never seen him try to catch somebody though. It's painted blue and white and has the police lights and sirens bolted to his roof.

I usually take a peek at the driver before I go race with him. Cops usually wear uniforms even if they are driving unmarked cars. So the tell tale sign is the police badge on the shoulder of his shirt. If they are plain clothed cops driving unmarked cars, then there is no way of telling.

Ok, I gotta chime in on this, in my own opinion, of course.

Don't take that advise about proving your ignorance and scared for you life, etc. If I were a judge and I heard that crap, a CL driver going that fast, I would throw the book at him so hard....

Nobody who's scare for their life from another car, drives over 100mph on the freeway trying to get away. Only racers drive that fast. When was the last time you saw someone trying to get away from someone else by high speed on the freeway? Yeah, it was in a movie....NEVER!

So here's my advise: pay the fine, plea bargain if you can, and try to stay out of courts and as far away from lawyers as you can. Being in court makes you vulnerable and out of your control....an awful feeling indeed. As for racing, I race, too. That's unfortunate that it had to be a cop you raced.

Entrapment? The police have to do something criminally illegal to lure you into committing a crime. It doesn't matter if they just simply lure you into doing something illegal, only that what they did was illegal to begin with. So if they take a wallet and they abandon it on the bus stop bench (legal) and they wait to see who steals it (illegal), too bad for the perp, that's not entrapment. What was it that was illegal that the cops did that made you break the law?

Speeding and traffic violations are not criminal anyway, so we as citizens don't really have that many rights. Meaning even if all the city residents come down to city hall and demand ticket writing stops, won't happen. The non-criminal consequences of traffic violations (fines, license revocation) are not heinous or inhumane or hardship and are therefore very, very difficult to defend against (overturn).

Because so many people have turned aggressive driving and road rage into other criminal acts (hit&run, murder, etc), cops are going to nip it in the bud early and stop the road rage to begin with. There's too many cowards on the road and the cops are going to protect them from us and make some money at the same time. Has anyone notice how expensive this game has gotten? In 1985, my 110 in a 55 was ~$220, traffic school, no points, kept my Escort radar detector, no insurance increase, not even a threat of going downtown.

Just keeping it in the real world.

Well another bit of advice... find a lawyer in Staten Island ... schedule an appointment for consultation and see what your chances for winning. Find a lawyer of good repute and one that knows the judges well. Connections ... u need them. Good luck.

In my town, you are wrong Mr. Ken, The last time I get a ticket for: " Failure to inspect a brand new CLS within 10 days!!!"

It was a criminal court, a crimnal offense, if I do not show up in court or plea guilty and pay the fine, an arrest warrant would be issued, I would be arrested on spot!

And this is for what? failure to inspect a brand new car!, For god sake why we have a law to inspect brand new cars, in first place!!!

What I hate most is that I see a lot of fuking cars driving at night with a single headlight, and never been ticketed, what if I though it was bike and I hit it head on!

Just just target those driving new shiny expensive cars!

Some sections of the expressway have a 50 mph
speed limit. I'm not sure on the details of the reckless driving - we keep ya car law, but the paper had a story about a guy on the belt pky going 100 mph @ 1 in the morning the day the law went into effect. He was the first one to have his car taken away. I think ya safe with that because they took his on the spot just like drunk driving.

So NYC has four ways to take ya car;
1. Drunk driving
2. Reckless driving
3. Soliciting a prostitute
4. Car used to transport or sell drugs

*I don't know all the details of the laws above, but in all cases the city keeps ya car (but you keep the payments)

In my town, you are wrong Mr. Ken, The last time I get a ticket for: " Failure to inspect a brand new CLS within 10 days!!!"

It was a criminal court, a crimnal offense, if I do not show up in court or plea guilty and pay the fine, an arrest warrant would be issued, I would be arrested on spot!

And this is for what? failure to inspect a brand new car!, For god sake why we have a law to inspect brand new cars, in first place!!!

What I hate most is that I see a lot of fuking cars driving at night with a single headlight, and never been ticketed, what if I though it was bike and I hit it head on!

Just just target those driving new shiny expensive cars!

Yeah, I should have been more specific what I meant by criminal. It's not exactly a crime by not getting your new car inspected. Your feal crime is: not obeying the judge and his orders to appear/pay. That's why you get arrested/warrants.

You don't have to be read your rights for a traffic violation. You should read the laws in your own state. They are quite interesting.
