ok so i need some legal help

I dont know if this is even possible but i cracked my rim on the inside lip a few days agao. I went to discount tire and they noticed a bend in the rim right before the crack. They said that with a bend after a few days the wheel would stress then crack(which happened to me) ok here is the problem. i was pulling into a girls neighborhood at night going about 25 mph. there was road construction and they had cut across the road. There was about a 4 in drop in the pavement that stretched across the whole lane so u had to hit it. it really made a loud thump and shaked my car pretty bad. i was almost postitive i bent a rim or something, when u hit 4 in of pavement with 19's somethings gonna give. this happened 5 days before i had a flat tire caused by the crack. is there anything i can do about this to the road crew that would make them buy me a new rim? I cant keep buying rims so im headed to the stock rims

I'm pretty sure you are out of luck. The city will laugh at you.

leave out the part about someone giving you a heads up about the fact that the rim might stress and crack, then I would say MAYBE.... If you're extremely lucky..... and everyone involved with the construction crew is a complete asshat, then maybe you would be able to pin the responsibility on someone else.

That being said, I think you've just been by the 4in drop

Go to your city hall and file a complaint. Unsafe road hazard, maybe (that's what I did).

About 3 years ago I bent a rim in Costa Mesa, CA due to a pothole, I complained to the city and they sent me a check for a new rim and tire. They really didn't give me any trouble either.

You need to go take some pictures of what you hit first..then take it up with the county, city or town. They should do something, be persistent. Remember when you take the picture thrown in a ruler for some type of reference like the CSI guys.

If the government was doing the work it may be easy to get $$$ for the damage.

If they hired a contractor to do the work, it may be more difficult, require a case in small claims court.

Help on the rim

In ZNC this is called a TORT claim. They are pretty lenghty and not easy to get fufilled. At least not in our state. You must make sure that you have pictures of the incident that include landmark or street id. They messed up thing is that if you dont submit everything correctly they will come fix the hole and deny compensation. The reason the claim is so hard in NC is because this is a at fault state. So no matter what you are quilty to proven innocent. They will claim that it is a privialge to drive on the roads, adn that if you were driving corectly and legally that you would have been able to slow down or avaoid the hole. You can do a NCDOT.org search for the paper work, I think you have 90 days.

How did you hit the drop? Straight on or at an angle? Personally, I don't think you stand a snowball's chance in hell since the city will say you should have driven slower, there were warning signs, etc. Not only that but you are using mere supposition to "determine" the wheel was bent at that moment when you in fact, likely do not know. Im going up to the city hall tommrow, im pretty shure this wont work but o well, might as well try. I hit the ledge when i was turning into the neighborhood (more at an angle than straight on) and there wasnt any signs that said broken pavement. but i dont have any proof that the ledge caused my rim to bend unless i say that i checked it right after i hit it but i didnt so who knows.
