when i first went to pick out my color for my cl-s, i wanted the blue with a black interior. but unfortunately the brochure and salesman said that it only comes in parchment (tan). so then i settled on silver (2nd choice) with black interior (having the black on the inside was the main concern)...and so today i went back to the dealership, and whattaya know, i see a blue with black interior 01 cl-s! two of em. i just got my car yesterday, so i felt upset! unfortunately after talking to the general sales manager, i was informed that i couldnt do anything about it. at first i was enraged and felt cheated...but the more i convinced myself that silver was a good color, the more it made sense...darker colors are harder to keep clean...and scratches show easily.

Bullcrap. Most states have a 3-day rule. You can just take the car back within three days and anull the deal. Look at your contract and then take the car back. The money is the same just the features and VIN are different. They can change that and redo it.

this is what pisses me off about acura though...their dealers do this shit, then they're rude to you when you complain to them, and then when you complain to acura, they say that the dealerships are independent and acura has no real control over them, they just record the complaints for their records and give incentives to the ones with few complaints.
most of the shit my dealer did to me is wrong and could even be considered illegal and misleading, but there's no way to prove that considering i didn't have anything in writing.
and as for dealers knowing anything about their own freakin cars, my dealer, frank coppola (lehigh valley acura) told me that the car has exxon headlights (didn't know exxon-mobile makes headlights!?), and the strut tower bar was to prevent the engine from entering the passenger compartment during a crash. this is the same asshole that told me that i get 2 free updates, and this is the asshole that took my $100 rebate coupon because i bought from the dealership before, telling me i'd get the rebate in the mail, but then fucked with me for 3 months, and then had his manager tell me, "there's no way in hell you're getting $100."
i'm sorry, but this is the last acura i'm ever buying.
I wanted the blue also. My thoughts are, just like PDG, the Aegean Blue is a trendy color that will pass. Compared to red silver black and white, do you think you would have been happy for several years with it?

Maybe the 3 day interval wouldn't apply IF you tell them your doing it simply to change to another color. But it does apply on any major business transaction. If it's not more than 3 days then tell them you made a mistake and can't cut the deal. I'd bet they wouldn't let you walk out with your money without first trying to put you in the one you want. (black int. I luv it) Why settle for something you didn't want especially if they have it. You might always wonder, what if......?

rise.........you sound young. Let this be a lesson in car buying for you. Before you buy again, arm yourself with everything you need to know about the car you want to buy. If the salesman lies (most do), you'll know when to walk. Enjoy your silver ride-it's a beautiful car. I'm enjoying my gold by the way--and I will like it later--trendy or not.
The law on car returns varies by state.(referred to in another post as the "three day rule"). However it usually applies to all car sales - regardless of why you're returning it. It probably won't say anything in any contract you were given by the dealership in purchasing/leasing the car. Call the general manager and tell him that's what you want to do. If he says no such rule exists, call your State Attorney General office and confirm it with them. Time is of the essence, so don't diddle around with people and let them take a day or two to get back with you. You'll need answers and fast. One thing that might be of your advantage is that I believe in some states the days are counted in business days. So Sunday and nat'l. holidays may not count.
Good luck! If you're stuck with the silver then you still have a great car in a great color. Always remember that car dealerships are not generally known for their honesty and intelligence. Buyer beware - always!

I agree with most of what has been said here. Try and take it back with the 3 day rule but I would call first and find out if this rulke does exist.
but most importantly let this be a good lesson . the comment by thholr seems exactly like the kinda crap dealerships (no offense, wayne) like to pull. As a matter of fact, that's exactly how i got such a deal on my PDG beauty (trendy or not, I LOVE my car color). They had the car sitting there in May when I first looked. I didn't buy until October and they still had it. They gave me a good deal just to move that vehicle off their lots. Fortunate for me, but unfortunate for you.

The 3 day rule only applies if the sale did not take place at the dealership. It's called the Home Solicitation Rule--protct people from salemen who come to the customer's home like home improvement companies.

Don't forget, Smithtown Acura is a great dealership- the sales people have been there "forever" (so no pressure sale, generally informative), manager is cool, and service is great. One of the service guys is in sales now, very nice guy.
Unfortunately, some dealerships do suck.....like all businesses.

I honestly don't believe there is a three-day rule to change your mind on a vehicle purchased after you've signed the contract, paid the money, and took possession of the vehicle.
If there is a lawyer who can chime in, please do so because a lot of folks are starting to buy into this 3-day rule. If there are legal issue that can void the contract, I agree. But you cannot void a contract if you change your mind, or you find a better deal, or your wife says "take that ugly car back" or whatever.
Here I go again, trying to recall info from my law classes long ago, so I hope someone can prove me wrong quickly with some facts. There no such thing as a "major purchase", there's no "I was misled" only fraud or mistake, etc.
The cooling off period applies to contacts for real property (land). If your state passes laws specific to cars, I stand corrected. If the contract at the bottom says you have 3-days to come back, I stand corrected. If the dealer verbally said "bring it back in 3-days if you don't like it", I stand corrected. But what about the dealership? Can they ask you to bring the car back tomorrow if somebody else walks in and says they'll pay more that car than you did? If they cut you a sweet deal and the finance manager comes back from vacation tomorrow and says "Hell no, get that car back", can they refund your money and get that car back? Seems to me the contract has to work both ways to be fair.
If you traded in a vehicle, do you get your trade-in back? What if they sold it to auction already? What about 3-days worth of interest on the $35,000 loan? What about the mileage on the car, I drove it 400 miles already, is it a used car? In some states, you take your license plate off the old car and put it on your new car and register it? I did this already, how do you reverse this if the State has already been paid? What if the dealership ordered the car and had a spoiler put on it at your request? What about that $500 security deposit (not the downpayment) you put down, do you get that back too?
If you wake up in the morning and that red is not the same red you brought last night, you might have a case. If the typed contract says 6cyl (by mistake) and you find out it's really a 4cyl, you might have a case. If there is a significant mathematical error on the contract, you might have a case.
But if you find a better deal at the Acura dealership down the road....? If you lose in a street race with an IS300....? If this hot chick at the mall says she doesn't like guys who drive red cars....? Does the dealership need to wait 3 days before booking sales, so on the 30th, he just might not have made his numbers depending on how many of these come back.....?

kensteele is absolutely right--see my earlier post. It's the Home Solicitation Sale Act. You can't return the car w/i 3 days unless the deal was substantially done at a place other than the dealership which almost never happens in a car deal.. Some states have other rules but I don't think any of them let you revoke acceptance unless the dealership committed FRAUD or the car weas nonconforming to the contract which is highly unlikely for a new car.

For some reason I thought that the 2001 CL-S only came in silver, red, ugly ass gold, nighthawk black and white. The monterey blue comes only with the CL model. Isn't that correct?
unfortunately, at the dealership i bought from, there are signs everywhere that say "there is no cooling off period. all sales final." or something like that. i even signed the contract that stated there is no 'cooling off' period.

The dealer was only partially wrong about the Blue/Parchment. The CL-P is only available in Eternal Blue/Parchment and the CL-S is only available in Aegean Blue/Ebony. There's still no excuse for the salesman not knowing his product - especially when one equipped the way you wanted arrived the next day. The dealers know in advance what cars are in transit to them.
Barry is correct about that, as a matter of fact, they have a print-out detailing every aspect of the next shipment they will get in, and have in, so he had no excuse that "he didn't know".
As for the "no cooling off period" signs. If the state allows it, postings that say otherwise do not supercede the written laws. They alway post "No currency over $20" or some such idiocy. Well, the store cannot refuse to take ANY paper currency. It's says right there on it good for all debts public and private. They may not want to take it but it's federal currency.
I had a $100.00 and the gas station person pointed to the sign saying they wouldn't take anything over a $20.00. So I said, " that's fine, but I tried to pay you and you refused to take my money, so I guess it's a freebee." They respond that they'll call the cops if I don't pay. I say, "go right ahead". They do and about 15 mikes later HCSO shows up and we talk. I don't have anything other than the $100.00, and before it gets out-of-hand I attempt to show them what the green piece of paper says about debts and such. The Deputy waives this away and tells the clerk that they can't decide what kind of money they are going to take. If they don't want the money, I'm free to go, if they want to make change..make change and stop wasting his time. Moral: Just because someone posts a sign doesn't mean that's the law.

dee, your argument is flawed. I have no doubt the situation occured exactly as you explained but just as the sign posted doesn't make the law, the police officer who arrives on the scene of the dispute doesn't make the law either. It's too subjective, the next police officer who arrives for the same thing might have a different idea.
I'm more inclined to believe this: the bills are legal tender for your debts. If you consume products or services, you should be able to repay in whatever currency you choose. Not a problem since there are no bills larger than $100 in circulation. Businesses who ask for monies in certain denominations are only asking in the eyes of the law. But it is not entirely optional for you either. You must comply if you can or else we resolve the problem fairly (it works both ways). You pick up a pack of cigarettes. $2. Store says nothing bigger than $20s. You only have a $50. They don't want it. Are you free to take off with the pack unless they accept your money? Or do you put the cigarettes back? If the police arrive, would they tell the clerk if he doesn't accept your $50, he'll let this customer and all future customers walk away with the goods without paying? Even if you have a $5 bill in your pocket?
A lot of times the large bill requirement is for change purposes. This business doesn't always have the cash on hand to make change. What if they don't have enough change to give you $48 back? Do you still get to keep the gas or cigarettes? Wouldn't it be fair to allow you to break the $50 someplace else and repay later? Will the police let them keep your $50 if the clerk doesn't want to give you your money back because he can't make change? Come on it's gotta be fair, you said if this isn't doable, you walk away with free goods, aren't there some instances where the merchant makes out with free money? Not likely in either case.
Cases like this might end up in court. And from what I remember, courts are not likely to allow you to [completely] walk away without paying [something]. 
It depends on the circumstances. Have you ever been thru a toll booth? Try out your deal there...and explain to the police that you didn't have the coins but you have a $100 bill and you just drove thru anyway because it should be free if they don't accept you bill at the manual lane or the automatic basket. You'll get a ticket.

The Federal Gvt doesn't guarantee that everyone will take the money. And every business in the US doesn't have to even take the dollar bill. Haven't you seen UPS say "no cash", or a gas station that says "credit cards only"? Granted most have recourse to enforce this (you can't pump unless you pay with credit card first or you won't get the package physically unless you use a money order). It's legal. They don't want to handle cash [for your debts]. P.S. I know what you are saying (you're talking about "As Is"), but the signs stating "no cooling off period" are not intended to be the law. They are just a friendly reminder of what the law already says.

Ken, I do see your point. FexEx, UPS, and similar business have a company policy regarding the acceptance of cash, for various reasons, but this business did indeed take cash. I'd already had the product (gas). At that point they could just make change or bite me. I'd also agree that if I were in there and wanted some gum, and only had a $100.00 or a $50.00 for that matter, I'd have just packed it in and gone somewhere else as gum's not a requirement...gas, however, is. Not to mention f(in the gum hypothetical) I hadn't used or received their product yet so "no blood no foul" kinda thing.
However, after saying all that, I'm hard-pressed to disagree with your well-stated reasonings in the latter part of your missive, so I'll yield the point.
