Got hit by a drunk last night
This just pisses me off.

I went on vacation and was parked in a hotel parking lot and get a phone call at 1 in the morning saying someone had just backed into my car.
I get outside too look at my car and of course it is extremly dark and can't see shit. But the guy and the night clerk is out there so I start looking at my car and see some minor damage to the rear bumper and a huge scuff mark. Well I start getting the guys information and can smell beer on his breath. Well While I am stalling getting his information the police roll up and start talking to him and after about 20 minutes put him in the back of the patrol car.
Now in New Hampshire you don't need insurance, so I don't know how I will recoop the possible damage to my car.
In the morning when I can clean off the scuff marks and get a good look at the damage, it is almost negligable. maybe a 3 inch very light crease in the rear bumper that unless you look for it you can't see it.
But I will still have my autobody place look at it.

in my case, I have uninsured driver insurance. I had to pay a deductable of $250 and my insurance co. took care of the repairs. Then they sued the lady, but probably didn't get shit, she was driving a POS.

I did thank the night clerk. Because it was her that called the police on this asshole. And I was able to get all of his information.

I am actually vacationing in Maine. I just stopped over for the night in NH. But NH is a beautiful place and have vacationed here before.

Sorry to hear about the car. You should contact your insurance and see what they will do. Likely, you will pay your deductable and the your carrier will pick up the rest. You are certainly free to take the guy to small claims and sue him for the amount you pay out of pocket. Your insurance may go after him for their loss in making the repairs(subrogration). Do you know he has no ins? Just b/c is is not reuqired does not mean he does not have it. You could also skip your ins. and just get the car fixed and sue him for the damages. The issue here is not winning the case it is collecting the money. Winning is easy. Getting paid is not. (yes I am an atty and not I am not giving you legal advice)
