First ticket in 4 yrs! Please Comment! (Pics)

This afternoon, I was pulled over by Hudson Police Officer.

Here what happend.

1) I merged on Rt-3 South On Sagamore Bridge between Nashua and Hudson.
2) I proceeded as you usual. Speed limit is 45 MPH.
3) I wanted to take the left most lane because I need to go left at the light 1.5 miles away.
4) On the left lane there was a black Chevy on my tail. And he WAS speeding. I passed him and took the left lane and kept a safe distance and he was Tailgating me! Now, I am still in 45 MPH zone but there is a sign that 35 Reduced Speed Ahead.
5)Just Before I reach the 35 MPH zone a cop point to me to pull me over and I did immediately.

The cop claimed:
1) He clocked me doing 65 in 45 Zone, then 61 in 35 using a laser gun!!!

After talking to an angry cop. I was polite but the cop did not budge. I explained I was not speeding, only after merging I wanted to pass to left lane and the black chevy was tailgating me.

He Asked me for my Lic and Reg Paper... He even threatned to arrest me!!!

I was shocked to see he wrote me 61 in 35 zone . Which is totally untrue as you will see in the evidence pcitures below.

He asked me to take my Lic and Regi papers and leave. I went home grabbed my Dig Cam and drove back and took pictures.

Here are the pictures:



Here You see where the Cop clocked me. The sign is reduced speed ahead. Zone is 45 MPH. The cop is at least 1/2 mile away. How come he can see me and clock me from that distance! AM I the right car? or is it the black Chevey that it was in the left lane behind me?


Here is the cop just at the border zone 35 MPH.


Again, Here is the cop just at the border zone of 35 MPH. How come he wrote me in 45 MPH and I need at least 150 ft to slow down from claimed 61 MPH?!!


Approaching me....


He is even standing in 45 MPH Zone!!!


He noticed that he standing in the wrong zone... He walked back!



Back again in the 35 MPH.. doing his stuff!!..

I will clearly plead NOT guilty.

My defense:
1) He wrote me in 61MPH in 35 Zone. I was in 45 Zone as I you can see in the pics. If you can't trust him for him falsifiying the Zone, how should I trust him for the actual clocked speed he wrote me!!
2) He was at least 1/2 away. There was a speeding black Chevy. My CLS is black too!.. Was I the wrong car he pulled?
3) When I passed the black chevey, It was tailgating me. So, I had to keep a safe distance. What shall I do let him hit me?!!


What do you think? Please comment. This is the first ticket in 4 yrs. Please no flames.

Good luck fighting the ticket. I can imagine that it was a costly one. Looks like you are getting falsely ticketed so hopefully you will get a good judge.

I don't get why the cop is in the pictures...? Was he there when you came back with your camera? Or was he just sitting there behind the 35 sign tagging people in the 45 MPH zone and saying they were in a 35 MPH zone even though he was and they were not?

I always thought that you had to slow down when you SAW the signs not as you pass them.

The cop was there when he pulled me over and when I came back, and it is exactly true what you said. He was just there behind AND front the 35 MPH post and he wrote 35 when I was in 45 MPH zone!

I say you show up with all that you walk. I got a squealing tires ticket and I just drew a sketch that showed I had to get on it to avoid an accident. The prosicuter reduced it to a busted tail light. Just dress well and be polite when you go to court. Nice work!!

So did you take those pics as he was coming up to your car? Or did you run home and take them as you drove by or something? I'm confused.

I called my wife, she packed my DigiCam, went back home, grabbed my DigiCamera, went back to the same bridge, and pulled over and took pictures. Anything wrong here?

One thing to note I tried to shake hands with the cop and politely asked him for his name before leaving... he replied it is written on the complaint form ( ticket)

Additionally, At 4:00 PM the sun is low, the Sun was in the eys of the Cop. This can affect his eyes and distinguishing which black Car he clocked. The cop was wearing dark sunglasses too! Sun Rays can greatly affect the accuracy of the LASER when it is directly in the face of the laser gun!!

Now,

1) I will send NOT Guilty Plea to NH Saftey State Department ASAP.
2) I will print all photos (5"x7" or 8.5"x11") . I will bring a CD with those photo to be entered as evidence in the trial.
3) I will prepare a detailed list of notes and my defense pionts.
4) I will dress up appropiately.

you could prolly just pay a lawyer $50 to get it thrown out for you... then you don't have to waste your time appearing and pay the $35 court fee

If a lawyer is not too expensive, I would show up in Court with one. Those f*ers take you real serious when you have an Attorney persent.

Good job Nashua. That's some fine work there. I wouldn't have had the balls to get out and take pics on the freeway while he was still there.

Check into two things to make sure you case is completely solid. Does the speed limit start at the sign or does it start when you see the sign (if there is a pre-warning sign). Second, make sure you explain that even tho these pics are not of your particular incident, the cops was in the same position as shown in these pics when he clocked you.

Never mind the laser and the black truck behind you...you can't fight that anyway. You don't need it, these pics are great. Don't let this go to the courtroom, you don't even want to face the cop or talk to a judge (who might think you are "arrogant"). Work on the prosecutor before this go to trial. With these pics, I don't see any reason why he won't drop the case. It just looks bad on them and if you have to push it, remind them how many other tickets were written in a 35mph and how the PD is "cheating" on motorists. "Would you like these pictures to end up on the 10 o'clock news?"

Good points here.

Evidently the first sign reads Reduced Speed Ahead 35 miles.The second sign Reads Speed Limit 35. So, between the first and the second post it is not a 35 MPH. It is still 45 MPH. Can any lawyer agree with me on this issue?

Second, exactly true those pictures I took to show the same exact position of the officer after he pulled meover. He did not move his position when I took the pictures.

Third, the last I was in court for non-moving violation, the prosecuter (No officer showed up) propsed to postpone the trial for 90 days if no new citations till then the case is dropped automatically. It could be the same this time too.

I wish you luck and I think you have a pretty good chance of getting the charges TOSSED.
Either that or at least adjusted to show 61 in a 45 zone which is more accurate.

The only problem I see is that the pictures you have are of the cop clocking OTHER people, not YOU.
It’s your word against his as to where he clocked YOU.

Cop did not move his position. The purpose of the photos is to show that the cop was standing in 45 zone and he claimed I was in 35 Zone.

I did no use V1 since it is a short distance trip. A lesson to learn use V1 each time I am in the car

Right, but your ticket was issued earlier.
You got pictures after the fact.
Who’s to say where he was standing for THAT one.

Shawn, yes you are right. I am sure that the cop will testify that he did not change his position.

Also, I can plea No Contest. What does this mean other than paying the the full ticket fees (I can pay via VISA CC)? Is it the same as guilty? is there any DL points? What about my driving record?

Dont bring a lawyer with you, they will charge more then $50. At least around here.... Anyways, if you desire an attorney, you can snatch one up at the courthouse. There will be other attorney's for other clients, approach one of those attorney's and he'll represent you there... most likely for 1/2 off what he charges most of his regular clients...or a significant discount from what you would pay if he came out there just for you. My friends do this all the time.
