Dealer gashed my wheel!!!

On Wedneday, my car went in for its 7500 mile service. Everything seemed in good order until I walked around my car today (Friday) and noticed a HUGE gash on my left rear wheel. I know for certain that it wasn't there before, since all 4 of my wheels were in EXCELLENT condition prior to the service, as I make sure never to park even in the vicinity of curbs.

My question is - Is my dealership (Niello Acura) liable for the damage my wheel , or am I just plain screwed?

Cliff Notes: I'm fed up with Niello. This is not the first time they've done something to warrant me getting pissed off at them.

Hell yeah!

Make them get you a new tire, then kick somebody's ass!

If you need help, post a thread, mount up a posse, and roll thru there deep and ready for some action.

Or, you could just call the cops and the Better Business Bureau.

Yes, they are responsible...stay cool and be cool. If they give you shit, immediately ask to speak to the Service Manager and be firm, if he gives you shit, blow up at him. However, this does go to show you that you should always do the walkaround at the dealer, man!!!

My cousin, Xenon7 had the same thing happen to his CLS, took it in into the dealer for 15k service and left with a huge gash in the left front rim from the carwash. (all 5 spokes)

They gave him a new rim and he kept the old one to their disay.

So make um pay and don't get mad.

Holy Crap dude, i had the same problem at Niello last week. I took mine in for the 22.5k service and knew they would be rotating tires and checking my brakes so i specifically asked my service advisor to look at my almost brand new Volks and see that they were perfect and then assure me that they would be very careful. He even wrote down 3 times on the service order "be careful " Well when i picked up the car i didn't notice it, but when i washed the car the next night there it was, a large gash on the edge of the rim on the drivers side rear ! I called immediately and brought it by on Wednesday and they agreed to fix it or replace it. They are gonna send it out and give me a loaner. I know i didn't do it cause it's garaged and i don't go near curbs. Also there was no damage to the tire or the rim protector so he agreed it wasn't a curb. So it had to be their equipment. I like Niello and have never had a problem with them, and he was very courteous to me. So maybe you should take it back and see. By the way was the gash on the passenger or drivers rear side ? If it's the drivers side, then we got one hell of a coincidence here.

Drivers' rear side. Hmm... from the looks of it, their equipment must be at fault here.

Never know... Some dealers can park the cars on "lanes" with curbs on eitheir side of the service department (I've seen the driver's side sitting next to a "curb" (and it wasn't the street's...)

The stock wheels are just Soooo easy to wack... (If you look carefully at the wheel, you might even find some paint or pattern to the damage [I guess I’m a closet PI/detective])

If the wheels were Volks (forged/light allow), and I caught them being damaged (without some kind of pre-signed waiver), I'd make the sucker replace the wheel. No telling how the structural integrity of something like a SSR or Volks would be effected by THEIR fuck-up...

AND

Even with a walk around before and after, there is stuff that can get missed (I know from experience... AND I've gotten "burned" a few times)

..good luck and the advice about being firm but polite is a good start... (Hopefully, they you can find someone that hasn’t been assimilated by the Borg yet…)

They should know better. I'm sure you are not the first one to complain about it. Bastards

don't assume its your words against their words

also dealers especially service reps know how to bull shit

so out smart them

go in

talk to the same service person who took care of your car

ask for the names of the techs or mechanics that serviced your car (they should have a record for this or you have a strong case)

demand that all of them meet by your car

then explain to them that you went into the dealership with 4 perfect wheels and after leaving you came out with only 3 good wheels

ask them how this may have happened

did you drop the wheels while rotating the tires?

was the car wash the culprit?

lack of care?

try to keep them all together and in your sight and observe what they say

all this will help your case if they say they cant do anything about it

it beats

"hi, i have a fucked up rim and its because of you"
service guy
"i'm sorry to hear that, let me go check on something" he leaves the office and goes into the garage and talks to the mechanic

"hey do u know what happen to that guys wheel"

mechanic
"yeah i dropped it"

service rep
"ok ill just tell him that you said it was already like that when you rotated his tires

mechanic
"ok"

service rep
"sorry sir but our mechanic said it was already like that, besides its been a week and you should have told us sooner"
