Damn chick hit my car!

A 37 year old woman hit my back bumper while I was stopped at a red light! When we pulled over, she tells me, sorry I wasn't paying attention%!%?"?$/ Damnit! Anyways, I don't have pics for the moment since it's night time and it's too dark for the pics to turn out good, but the dent is in the middle only where the license plate is.... There are several scratches around the molded square of the license plate. I won't claim off insurance, that's for sure. Just not worth it! I was thinking of getting a new bumper, but it might cost too much for nothing and there may be a noticeable difference in the new paint of the new bumper and the rest of the car.

I could also bring it into a shop to mold it back together and retouch the paint....

Any suggestions?

She admitted fault. She is automatically guilty. Get your money.

the thing is, I don't want a claim on my file just for 500-600 bucks, even though i'm not responsible. In quebec, canada, how it works is that my insurance pays for me and her insurance covers her costs, no matter what. the only way I could get out of it without it costing me anything is if I tell her: I won't be claiming but pay up! I donno if that's gonna work though.

Damn, i'm still very pissed!

That no-fault crap sucks! It's her fault and it cost you money! I'd still put in a claim. That's why you have insurance. I assume you pay a lot in insurance because of the no-fault crap, you might as well get what you paid for.

No no, it is her fault. IF and ONLY IF I claim, she will get a claim on her insurance profile stating that she was at fault. If I don't claim, she'll get away with it. What I'll do is call her back and tell her that I won't be claiming but that she must at least pay for half the damages.... boy I'm a generous guy

Don't pay for half of it!! It is not your fault, so why should you pay?? Tell her she can either pay for all of it in cash, or deal withan insurance claim. I am not sure of how things work up there, but did you get a police report??

yeah you guys are right. I'll push her to pay the whole thing. I don't want to have to go through insurance claims and shit.

And no, I didnt file a police report. Not for a small accident like that.

Do you guys know how much it would cost to replace the bumper?
Also, do you guys think that the difference in paint will show if I replace it with a new bumper?

Anytime someone hits you from behind it is THEIR fault, so it shouldn't affect your insurance. It would probably be cheaper for her to pay out of pocket, shouldn't be much more than 500 to repaint.

not your fault, and your insurance company won't penalize you for her stupidity. you should have filed a police report which would have issued her a ticket, good luck
