Car totaled...help

Hey,

a few weeks ago someone turned into me head on and well my car is totaled according to the insurance company. my cls had modifications on it and they are trying to tell me it won't be covered (I am not at fault).

any ideas/experience with this type of crap? the amount of mods in the car is probably around 8k.

sounds like a black market part-out sale to me

several of us are always on the hunt for used but good condition oem and aftermarket parts. im not sure you can really argue with insurance over coverage of bolt-ons unless you have receipts

the first answer is always no, and the people that mod cars knows its lost money unless you step your insurance up to cover it.

Now what kind of "mods" are we talking?

its in the tow yard still. I haven't settled or anything just seeing if there is a way to get compensated for the parts. sure some i might be able to take, but others are fucked.

lip kit is smashed, intake damaged, not sure condition of headers, dvd screen cracked, etc

Usually insurance companies have something you can add on for your mods and other stuff for extra on your premium. other than that full coverage doesn't pay for your "mods"

i understand from my company's point of view if I was filing the claim through them. the issue is I have a claim in with the other drivers insurance company (he is at fault)

If it was payed off take the 6 and keep it moving.
was it payed off?

I have 3000 extra coverage on my insurance for (custom modifcations).
You need the added option to be covered on aftermarket parts.

Yeah , 6k is way more money than the car is really worth in a sale . But I do want the manual transmission lol .

Will or does your insurance company cover the parts if it you were at fault? If yours does leave the negotiating up to your insurance co to go after the other parties ins. That of its time to contact a lawyer

you are going to have to buy the car back, hopefully at a non-rapeshow price... then sell all ur parts.

this is COMMON news bud... u mod ur car and don't tell insurance, they aint paying u shit... matter of fact u are saving them money cause what u modded is not covered and if u did not mod it they would cover damage to those parts. so they love ppl like us that mod the car and don't save boo.

i was in the SAME circumstances as u.. i got my guy at acura to get 5K from insurance.. then tell them he needed 1500 more to actually fix it up.. by that point they had to hand over the 1.5 cause they had sunk 5 into it already.... THEN when i got my car back i needed the roof completely re-bent so it would seal around the sunroof.. 1k later we were right at 8k from insurance and i got my car back after almost 2 months.

i dunno if u can get someone to tell the insurance company their quote was wrong and it will be less and to fix it.. or fix most of it then use ur money to get the rest done.

unfortunately ur in a shitty bind and i feel for you bro, and i am sorry you ,lost ur baby... when it happened to me i felt like my kid was on life support or something it was traumatic.

Sorry for your loss and its a tough situation your in. Most insurance companies won't reimburse you for things they didn't know about or things that weren't factory or dealer installed and some won't reimburse you at all for certain items even if you disclose it to them like: suspension and engine mods. Even if there was a chance they would cover any of that you would have to have reciepts and they would depreciate the value of them from the time of ownership. Good luck

This.

Your 8k mods aren't worth 8k anymore. You can try to talk with your insurance company and theirs to see if they can give you more but if not, just take the 6k and jump.

the insurance company needs to know u had those parts prior to the accident. or else everyone would be claiming they had a bunch of shit on their car when they had nothing done. at least that's how it works in canada.

The accident was their client's fault.
That puts you in a better position then when using your own coverage & declared value.

Show them that you've spent $8k above and beyond the book value.
In the case of our last two accidents (both NOT our fault) their insur company sent a second appraiser who documented that our cars were in deed more valuable than the "book value".

Also demand "loss-of-use" reimbursement for every day you'll be without a car (probably $40/day).

Worst case, tell them you'll take the $6k offer only if you can keep the "totaled" car too. Then sell it for parts.... You'll learn a lot taking it apart.

Maybe go see a doctor to make sure you're not unknowingly injured?
If they don't budge get a lawyer?

sorry to hear. accidents can be add than physical ache to your life. i agree with the other guys that you should take the 6k and try and get the car as well for nothing or as close as possible.

It would not matter. If you had the value of the mods written into the policy the other drivers insurance would have to cover it in the event of a total loss. Normally the best you can do is about 50% of cost of parts, labor is not covered.

I would buy the car back and part it out.

OP ended up getting a third party adjuster to get the insurance company to settle on a much better number for him. How much I don't know exactly. We know each other btw.

However he did sell the car to me and I will be doing a full part-out.
