TACOMA, Wash. - A father of four who shot a fleeing car thief to death has pleaded guilty to a reduced charge of second-degree manslaughter and could spend less than two years in prison.
Fredrick Tremayne Sims, 33, entered the Alford plea Monday in Pierce County Superior Court, maintaining that he was innocent but conceding he would likely be convicted if the case went to trial.
Judge Stephanie A. Arend set sentencing for September.
"He feels like he acted in self-defense," defense lawyer Ray Thoenig said. "The individual tried to run him off the road, and I think he was aiming at the car and not the individual." Sims could have faced 61/2 to 81/2 years in prison under state sentencing guidelines if convicted of first-degree manslaughter in the death of Carl "C.J." James, 15.
Deputy prosecutor Ed Murphy said he would recommend the low end of the standard range, one year and nine months to two years and three months.
The case, a source of intense local debate over the rights of crime victims, arose Dec. 14 after Sims, a victim of three previous auto thefts, was awakened by his girlfriend shouting that their 1985 Pontiac had just been stolen.
Prosecutors said Sims grabbed a .38-caliber handgun, gave chase in his van, pulled alongside the car a few blocks away and fired three times after failing to get the driver to stop.
Sims said had James swerved toward him, causing him to fear for his life.
First-degree manslaughter involves recklessness or disregard of a known, substantial risk. Second-degree manslaughter reflects lack of awareness of a substantial risk.
Murphy said he agreed to the lesser charge because jurors might have sympathized with Sims and refused to convict him of the more serious offense.

this reminds me of a situation one of my freinds was in back in 1995.
He was driving down the road with a freind (my freind was driving) they pulled up to a stoplight and there were 2 guys on a crotch rocket, and my buddys passanger said something like "look at those 2 homos" the driver on the bike started talking shit and then as the light turned green the guy riding the back of the bike shot 5 rounds at my freinds car with a 9 mm. my freind and his freind were both shot. my freind was shot in the chest, his freind got shot in the arm and it came out his pec muscle.
anyways the bike speeds off with the 2 guys on it and my friend and his freind just sit there for a minute trying to comprehend what just happend then my freind turned the vehicle around (he didnt realize he was shot yet, he didnt feel it he said) and started driving really fast to chase them down and to get to the hospital. anyhow, they catch up to the bike about a mile down the road and my buddy sideswipes the bike, knocking both of the guys off the bike and sending the bike skidding down the road quite a ways.
then my buddy and his freind drove back to his apartment which was across the street from a firehouse and they both got medical attention and sufferred no long term injuries or problems, just scars. both were lucky to not have gotten hit in an organ.
but it gets worse. turns out that the driver of the bike was a latin king gang member who had rich parents and the guy who actually did the shooting was trying to get initiated into the gang. so anyways, the driver of the bikes' parents SUES MY FREIND in civil court for purposely hitting the guys off the bike AFTER THEY FUCKING SHOT THEM!! they were found guilty of some intention to cause bodily harm or something...i dont remember the exact charge. but its fucking disgusting, the legal system in this country is fucking so messed up sometimes.

Almost exact same story happened in downtown Austin a couple years ago.
This kind of case invokes some emotion, but if the thief is running from you there is no threat present and if you shoot him you are going to prison.

if the thief has a weapon of any sort and it was drawn, then this guy would of got no sentence at all. and yes the judicial system is screwy, this has been for a long time now. not much one person can do to change the actions of judges all around the world. plain sad.

People are getting sick on thieves and crap people like that. One of these days, 'the law' will recognize this stuff and do something about it because having them sit in jail, feed them, educate them, entertain them, etc..at the taxpayers expense will soon have to stop.

and as far as how we pamper criminals. i could care less if we put them in a 6 foot square box and made them eat whatever insects came in to eat their shit. that would make you think twice about stealing that guys car, especially if youre a 15 year old fuck up like this ass clown.
there should be a law that is the exception to most rules. it could be called the "Darwin's Theory" law. this is, if the offender does something stupid, then no one is responsible for the consequences but the offender alone. so then cases like the burglar who fell thru a window and got stabbed by a kitchen knife and sues the home owner, would be thrown out and we wouldnt have this common sense problem.

Here is the deal guys. the car was an 85 which means no theft insurance. that is why the chase happened. Otherwise the guy would have been ass out. I say get your story straight. it goes like this. He had his hand in his pocket, and was taking it out. I saw light reflecyt off of something metalic. I WAS IN FEAR OF MY LIFE, over and over again. and make sure you shoot to kill. They will tell you in the concealed class, not to injure, but to kill. I think if some ass decides to mess with my shit, i wouldn't think twice about fragging his ass.
