Advice needed, shovel won't move this load of BS

1/27 6:48 I leave Home Depot got a shovel. Little did I know I’d have to use it to dig of the shit pile I was going to get into.
(Checked receipt time)

So I am driving, the road is 2 lanes each direction. The car is clear of snow, lights etc etc all good working order. There is a F150 3-4 car lengths in front of me in the left lane. I am in the right lane. He slows to allow a white SUV in front of him. About 20 -30 seconds later I notice that the SUV is not in a lane. So I figure if he wants to go slower that’s fine I should move to the left lane which I do. This way the left lane is free to do whatever he/she wants. So now I am about 2 lengths behind at 25-30 max and they are going the same speed. They still aren’t picking a lane so I beep beep, not a holding of the horn by any means. They move to the left lane and I come to a stop at the next light. They still in the right lane are next to me. It is snowing and they seem to acknowledge that there are 2 lanes (hence why they are next to me). We start moving and my car does not slip, I pull away at less than dry pavement acceleration. (Snow remember) I no longer notice the SUV and think nothing of it, as it seems to have moved somewhere else and is not taking up 2 lanes near me. I go through another 2 lights and all is fine, I am happy I have a shovel and listen to the radio. At the following light I am completely stopped and then see red lights flashing behind me. I move to the right to let them pass. They don’t pass and instead are pulling me over. I have no clue what I did unless my plates are not visible or a light is out that I did not notice earlier. I roll down the window and put my hands on the wheel. I was asked “Did you honk at me?” I replied no, “I don’t remember honking at any cops” I think to myself what the heck is he talking about. He says again “So you’re telling me you didn’t honk at me?” Again I said “no I’m being honest I have no recollection of me honking at you” And honestly I didn’t, there were NO cop cars anywhere, and though I wanted to look at his vehicle he wouldn’t allow me out of my car. He asked twice more and I answered “No I have no idea, maybe when I moved to switch to AM I hit the horn but I wouldn’t be honking at a cop for no reason”. He says “I don’t like your attitude” I assume thinking I’m lying or something. I wait for the next 15 minutes in my car, thinking about what the heck is going on. I realize he is plain clothed, and could only have been in the SUV. When he comes back to the car I said “You know what I did honk back there, there was a white SUV back there that was taking up 2 lanes and I let them know that I was to the left of them.” “If that was you then I did honk, the SUV was in the middle of the 2 lanes.” He says “you’re telling me that YOU can see the line?” I respond yes I can, so did the F150 back there.” “As a matter of fact you were next to me at the light and knew, and those people across the street know also.” “There are to lanes, three cars deep in each lane, they know” He was obviously ticked now and to be quite frank he hasn’t said anything to me about what I did except for “You didn’t honk at me did you?” He says again “I really just don’t like your attitude” he then says “stay in the car” and goes back to his vehicle. He comes back again 15 minutes later and says “I really don’t like your attitude, and you know your address on your license and insurance is different?” I responded “Yes my parents are at the license address, and I get the insurance bill at mine I moved recently” He responds “Change that” which I did this morning. He gives me ticket for Tailgating/Driving to close, never said originally why he stopped me, was in plain clothes and only asked if I honked at him. Please let me know what you think. Any advice is MUCH appreciated. Tailgating in NJ is 5 pts. It’s the 27th and I just feel he was in a bad mood. He gave me the ticket at 7:30 marked 7:15 on the ticket and said it happened 3 lights away from where I honked at him.

cops there have red lights?...................the moment I saw plain clothes I would have been gone

That’s a case of bad luck and an asshole of a cop. Sounds like the type that got picked on in HS and joined the force to get back at people. I know exactly what you mean when you say you just gave a *beep* *beep* with the horn. Again sounds like the cop was in a pissed off mood b/c in your story it doesn't read like you were tailgating.

You can always plead innocent and show up in court and argue it there. 5 points is freaking excessive.

Also it doesn’t sound like you were giving the cop attitude you just didn’t know what was going on.

Go to court. Plead innocent. You can get out of this one. Thats BS you were not doing anything of the sort. You were honking because he was driving in the middle of the damn road, how does that get you a ticket?

i would take it to court and fight it ....... its too bad there are no witnesses. but i would go and take a few pics of where you honked at him and of where you got pulled over . just to have a lil proof in court .....

It seemed my questions were already a nusiance, I was shocked I was pulled over for anything at all. That's why I answered the way I did. Is the red light only, plain clothed and unmarked car an issue?

I FKN HATE COPS....they preach safety and the law, meanwhile when theyre off duty, theyre worse pricks than anyone else, i should know, my cousin is a cop, ...he tells me how some of them steal money from drug busts, steal the drugs, stop good lookin women just to talk to them, and then act nice, and let em off.... etc etc....yes there are good cops out there, but there are more dirty cops than good cops...

2nd - Find out if he was actually on duty!
3rd - PLEASE do not settle for a lesser ticket or fine on your court date - you did NOTHING wrong

yes yes yes, They can't give you tickets or pull you over if their off duty. And they arn't supposed to pull you over with only red lights, its supposed to have blue as well. Unmarked car probably isn't a problem, but he was off duty.

I got pulled over one time by a guy in a "wildlife enforcement" black dodge with blue lights on the dash only. i was a little worried at first till the guy stepped out of his truck and i saw he was in plain clothes and it said wildlife enforcement on the door. Since i knew he wasn't going to do anything i just let him say what he wanted to say and then went on my way.

On a side note, it's aggrivating that anybody with blue (or red in your case) lights on their vehicle think they can just pull anybody over for any or no reason other than being upset about something :sqntfawk:

I don't know what the law is in NJ, but it's illegal to honk for no apparent reason in MO and maybe IL. Could be the same in NJ.

It really doesn't matter whether he was on or off duty or whether he had red or blue lights. What he did was give you a nuisance ticket. You have to deal with it now regardless. That being said, go to court and I bet he won't show up. If he does show up, tell the judge exactly what happened including the incident with the white SUV not being in the lane. Your honking of the horn was a warning that you were there. All of us would have done the same thing.

One question.... was he in the white SUV?

If he was off duty he couldn't give you any tickets. If he pulled you over it should be on camera, and audio may in fact been recorded as well, if not then it is your word against his, and in court that usually is bad for you. Maybe it was a scam if they didn't tell you who they were or why they stopped you. Maybe he stole your identity while writing up the tickets.

In court it will be a matter of you proving your story, too bad you didn't know anyone else who was around the scene at the time of the "incident".

5 points is a bit much, you can leave the scene of an accident w/o injury and get 4 points, but leaving the scene with injury is 8.

First of all, that cop should've been swallowed.

Second, I don't know about NJ, but here, no uniform = no ticket. If he's off-duty, then he's a civilian. Obviously he's just ticked off that someone honked at an almighty powerful cop.

What a faggot. Take his badge and gun away, and he's gonna be whimpering in the corner of his room for the rest of his life afraid of people.
