This is an infrequent problem for pre-05 TSX's and RSX's. I believe there was a TSB on this issue, but I'm too lazy to reference the bulletin number.
Owners with this issue report having to "slam" it into 2nd gear at high RPM.
It was a fitment issue and the 5th & 6th gears along with the 5-6 syncro were redesigned to improve clearances:
2004 TSX:
007 23580-RAS-000 GEAR, MAINSHAFT FIFTH
008 23590-RAS-000 GEAR, MAINSHAFT SIXTH
009 23626-PNS-305 SLEEVE SET (5-6)
Here's the post-TSB part numbers:
007 23580-RAS-010 GEAR, MAINSHAFT FIFTH
008 23590-RAS-A00 GEAR, MAINSHAFT SIXTH
009 23626-PNS-315 SLEEVE SET, SYNCHRONIZER (5-6)
If I'm not mistaken, Honda only published a TSB for the RSX-S owner because of the fact that the TSX is much more rare and usually will be associated with a less aggressive driver.
If I find the TSB, I'll give you the link.
Go to the dealer and have them check it out. It should be covered under warranty. However, don't shove the TSB in their face -- it's supposed to be a dealer-internal document only. Service advisors hate it when you try to act like you know more than them.
