***Accident*** For the 3rd Time!!!!!

Damn!!!!! Yesterday I'm driving home getting off the freeway and this white BMW rear ends me!!!!!! This is the 3rd time since I got the car in May of last year (all rear endings).

The guy that rear ended me offered to pay for it. Seems that he doesn't want his insurance rates to go up (I suspect he's been in a few accidents himself). However, last night I did call my insurance company and made a report just in case he decides he doesn't want to pay.

Let let you all know what happens.

Wow, sorry to hear about your accident. I am kind of in the same boat as you.....2 accidents since April 2004.(3 months I know....bad luck :'( ) One was the one I posted here about getting hit in the parking lot and another was when someone hit me during stop and go traffic and he fell asleep. (hit my passenger side)

BEWARE....I have yet to settle with the guy who hit me in the parking lot! It happened May 12.....so thats 2 months. He admitted to hitting me, claimed to want to pay out of pocket and then when I called him with the estimate he said he didn't have that kind of money. :sqntfawk: I hope you got all the insurance information, but DON'T hesitate on pulling the trigger and calling your insurance company and tell them to file the claim with his insurance.

You should be at 0% fault since he hit you from behind (thats how it is in NY). Set a date and tell him you want the money by then or tell him where to stick it. After this whole thing, I don't even give anyone the benefit of the doubt. The second time my car was hit, I got a police report, insurance info and was lucky enough the guy was nice and actually gave me $1500 cash the next day! All of the info I got including the police report didn't affect him or his insurance.....let him decide if he wants to play by YOUR rules!

That's my plan. I will talk to my insurance company's adjuster and discuss it with him/her. I also plan to have them look at the car and take pics before I take it to the body shop just so if run into any problems, at least my insurance has proof. If I see any resistance from him, I'll let the insurance handle it.

Sorry to hear what happened to you Yuhoo. My last fender bender was June 1st this year. Yup just short of two months.

Oh BTW, my dad told me that if this happens again, have the other guy give a written statement saying that he'll pay and have him sign it. That way, if anything happens, you have that statement. Just a tip for all of you.

The airbags did not deploy.

I don't think it has yet since the first two times, the other party's insurance company claimed liability and paid for it in full.

NEVER TRUST PEOPLE WHO CLAIM THEY WILL PAY. Because they won't. Let the insurance company deals with it. After all, it's the other guy's fault, why do I have to do a favor for him. him!!!

tough break. that really sucks that you've got so many hassles. unfortunately, drivers everywhere suck, not just in so. cal. and yeah, unless the guy is paying you straight cash on the spot? don't let him go without his insurance info and an accident report of your own. i always keep a template in my car to get down all the details.

If all goes as planned, I'm going to have the car inspected by my insurance company's adjuster tomorrow. Then, I'll drop it off at the body shop on Monday morning. Hopefully he'll pay up but if he doesn't I'll go through the insurance company.

When is the SD meet again. Isn't it sometime in August???

Just got the actual cost of the damages which turns out to be around $1100. I called the guy who hit me and he said that he didn't want to pay for it and he wanted to claim it on his insurance company (you were right vwong). So I will pay the deductable and have my insurance company reimburse me (good thing I reported it to my insurance). The body shop told me that it would take 3-4 working days to get the car fixed. I should hopefully get it back next week.

After seeing your pictures of the damages, it makes me more assured that I am in a safe car. If it was any other car, the bumper would have caved in like foil. Great car and the bumper should be easy to fix. I'm glad to hear that this case is settled for you. Good luck man!
