Wrecked!!
Sorry I haven't posted in a while I was involved in a 4 car accident in my 2.5. Some lady hit me and the kicker is she had no insurance and had about 6 warrants for her arrest and is spending the next 6 to 12 months in jail. So ya I had to file it under my uninsured motorist policy and pay a $250 deductable. She did a total of $4,375 worth of damage. Rear ended the hell out of me. I will have pics in about 2 days or so I will post them. Now I got to let my lawyer do the rest of the work. What a pain!!!!

I'm not taking my TL out for a week with this "great" luck we are having in our TL's... anyways... sorry to hear about your car... but remember... its better to pay the $250.00 deductable to fix the car than the $4,375.00... well good luck fixing it and again, sorry to hear about your car...

from the price of the damage, you must have major whiplash. It sucks how an "accident" can cause someone some time in jail... yikes. I was goign to advise you to go to therapy to make more money out of it but thats not going to help if shes locked up.

I am a personal injury attorney. Your UIm coverage is generally $20,000 for bodily injury, exclusive of your uim property damage coverage. If you start treating @ a chiropractor your lawyer works with, you can run up a $12,000 chiro bill and settle for the $20,000 policy limits. You UIM cant refuse to pay or else you can bring a bad faith lawsuit and get up to three times your damages.
Your lawyer would get 33 1/3 of the $20,000, the chiro would probobly cut their bill by up to 1/2, and you would get the rest.
You should be able to pocket between $5,000 and $7,500 cash.

UIM is uninsured motorist coverage. What oulaw is saying is that deluxe's insurance will pay out up to $20,000 to cover dc's medical expenses in addition to however much they have to pay out for damage to the car.
I must add that as a person who has worked, and who's family almost entirely works in the insurance, I frown upon what oulaw is saying.
I will admit that the primary reason why our insurance premiums have been on the rise in recent years is because the weak stock market. However, big frivolous gray-area lawsuits like this are still a huge burden on our premiums.
It's 10:31 pm and OU still sucks.
I must add that as a person who has worked, and who's family almost entirely works in the insurance, I frown upon what oulaw is saying.

Then as someone who knows the insurance field you know that while some personal injury attorneys took advantage of the insurance industry in the early 80's until the early 90's, that in the mid-1990's the insurance industry developed universal software called collosus that actually undervalues legitimate claims based on the fact that a certain percentage of claims are in fact either "grey area" or even fraudulent.
So in other words what we have is this. example (1) you are injured and break a bone or tear something = the defendant driver insurance company offers you all or a majority of their insured's policy limits. example (2) you have $1,000-$4,000 in property damage and a pain in your back that will not go away, but like many soft tissue injuries, will only show up on an mri as showing possible strain/sprain = the insured insurance company will fight the case and offer as little as possible, usually less than your medical bills (but if dwi or fled scene value same as example #1 even with soft tissue).
I have had 26 trials in minor impact soft tissue cases. The insurance industry knows I will win on liability, they just try to argue that the medical bills are not reasonable and necessary based on the collsion.
What the insurance industry wants is to say "you are forced by law to pay for insurance, but if our insured hurts you and there is no broken bones, we will fight it".
The cases I see that really suck are where someone is killed, and the defendant only has a 20,000 policy. What this means is that all that you recover for wrongful death is $20,000. (since the insured would file bankruptsy if you sued instead of taking the policy).
That took .3 hours to type so anyone who reads this owes me $125

The insurance companies are out to make the most money themselves. Plenty of times they don't dole out the cash people deserve. The $100,000 coverage that most drivers carry is nowhere near enough when you take out say $30,000 for the price to fix a car and then give the rest to cover medical. And the statistics are like 2/3s of drivers are naked.

If the woman is going to jail and has a bunch of warrants, she probably has no assets to collect anyway. This means the insurance company can't pay off dc and turn around and make back the money from the woman. This also means the insurance company will try and recoup losses SOMEWHERE. Alright fianlly went to pick up my car yesterday and guess what I got about 2 blocks and was so pissed I turned around and brought it right back to Caliber Collision because the allignment was so far off the whole car jerked to the left really bad. When I let go of the stering wheel it turned about a quarter turn to the left. I am working on the after pics but the before pics are here: http://www.cardomain.com/memberpage/614678
