Accident

Our car got rear ended. What should we do? Looks like a lot of damage, the person only paid us $400 canadian so far towards the damage. He doesnt want to claim insurance. police report filed. body shop estimate $2600+ hidden damage. so expensive huh.

what we gonna do about injuries? head and back pain

sorry to hear you got into an accident but...thats a lot of damage to not go through the insurance company and i hope you choose a good shop because there will be leaks around the tail light if not done right.

I would say give the $400 back and go through insurance. I mean, what are the chances this guy has $2600+ to give u...usually people avoid insurance if its a fender bender, which I wouldn't describe your accident as.

Oh, also, If you guys are injured I would say definitely go through insurance.

i would go through insurance especially for something like that... although chances are its not that much damage but if your injured in some way, put a claim

i agree man.. he not gonna cover u for head and neck injuries... go through insurance... u have the police report... trust me man i only had a scratch on my rear bumper from a rear ended accident.. it cost me 530$ US to sand out and refinish... u gotta replace a bumper. reinforcement bars... alot of work... that is why u buy insurance... in case sh!t happens.. he doesn't want to go through them cause he knows his rates will go up and its his fault.. unless u really close to the guy and can trust him... i wouldn't do it..

$2,600 sounds about right.
it'll cost me $500 to repaint my front bumper on my 3.2TL

- new bumper (plus paint and labor)
- new reinforcement bar
- new rear bumper absorber (the foam)
- repair and straighten the trunk lid (paint and labor)
- exhaust might be pushed in a little
- new rear bumper clips
- MAYBE straighten the frame (after taking off the bumper and reinforcement)
- from the looks of the right rear taillight, you might need to straighten the quarter panel. (check to see if the bolts on the light are still intact.)

if the bodyshop is going to repair and repaint your trunk lid, heres your chance to ask them to debage your trunk and fill in the holes.

Acura estimated $3100 today. incl. everything u mention, if exhaust needs change, i'm happy to get an aftermarket one.
good thing you mention debagging i want to.

the other party doesn't want to go through insurance b/c he already had an accident last year. he wants to pay cash. but we are unsure. But we don't want to screw him over b/c he was nice. Will his insurance go sky high if he has to give us an injury claim?

I guess the guy was nice for a reason, to let him off the hook easily.. If it was the other person's fault then let him pay for what he did. If he doesn't want to involve the insurance company he'll still have to pay for the damages.. Either way he's screwed. Yes, his insurance will go sky high if you report to him/his insurance about your injury.
Maybe this person is a crappy driver and needs to be taught a lesson.Tell him to take the bus next time since he already got involved in another accident. Its idiots like these that make people like us scared to be on the road and to waste our time going to and from a bodyshop... too much hassle. Claim everything.. make him pay for everything, the car, the injury medical bills (fake one if you can) take the extra money and modify the hell out of your car.

Hmmm....yep, that's HIGHLY illegal. And trust me, you WILL get caught. My friend videotapes potential insurance fraud cases with people. Almost 95% of the people are caught and face huge fines/jail time.

TLBaller : how much? and shipping to alberta canada? do you guys know if all first gen TL rear bumpers cover/absorber are the same size? 3.2and2.5?

what's the website u guys gave for good used parts?

if hes willing to pay cash and your not injured make sure he gives you the cash and then you shop around for the best place that will cover your car.. but if you are injured then you really have no choice, unless you have insurance and are not looking for a quick buck


for example
wife has 95 mitsubishi eclipse its raining, car in front stop hard for pedestrians, she slams on breaks, does not hit car, but back car hits her preety hard, kid is about 20, 21 on a toyota tercel with wife and kid ... delivers pizza for living. nothing happened too car (THANK GOD) so just got all info, told him as of right now were not claiming anything but if something should arise because of it, back pain, neck, stuff like that then id call him. he was young had everything just was scared of loosing job. that situation we just let it go, no injuries more important, so if you really see it that he is genuine, and there is nothing wrong with you work with him, but if you think hes just trying to get over you,,,, GO AFTER HIM!!!!

ps the guy was extremely gratefull because he coulda lost his job if we reported it.

That is a completely off base statistic...I am a personal injury lawyer and assure you its alot less than that, overall maybe 10% or less of minor impact soft tissue injury fraud claims are caught. This is because most insurance companies do not pay for investigative sevices where the Plaintiff claims $15,000 or less. Mostly you will see investigation in surgery cases where the medical is $25,000 or greater. Keep in minds that Allstate, Farmers, and State farm all use in house counsel to defend their insureds. The insurance companies have record profits because they pay less on minor impact medical claims. They can now afford to take more of these cases to trial since they use their own staff attorneys, usually paid about $50,000-$60,000 a year. To keep cost down, they dont hire investigators, instead knowing at trial they can argue that the medical is either (1) not reasonable or nessecary (inflated) or (2) was not caused by the minor impact. This works, because in those case 80%-90% of the time, juries award Plaintiffs less than their medical bills at trial. I know, I tried 25 auto accident cases last year to a jury.

If your gf has pain in her head and neck, you should talk to a doctor. If she doesn't feel the need to go to a doctor, I wouldn't bother with the lawyer and medical claims...
