They do run close to the ground sorta, they go down to the inside of your inner fenderwell, but you'd need to be in 2-3 foot deep water to submerge your intake. If you're worried about it, you can get a bypass valve, which is what i did.

I am looking to do the CAI.. or an ICEbox..???? I am fearing the water in my tranny deal. But I hear you can get a bypass valve.. I imagine its the foam seperator?

My bypass valve is the foam piece inbetween the 2 pieces of the cold air intake
