hi the car isnt currently at home but i said that the mark was like 3 finger on top of top hole in the dip stick but i am sure that is leaking atf because of the smell

^^^^^ oh no, its too much then, I would loosen the drain plug and let some come out.

I just have to ask, when are you measuring on the dipstick? With the car off? Car running? After driving? Cold start? There is a specific way to check transmission fluid, but I don't know it off hand. That could skew your reading as well.

like spill ATF on the floor? AT does have a vent valve and looks like it pouring out from there. I would not be worry so much about the AT, how many you drive since the overfill happened?

I would definitely drain some out... You will probably have troubles eventually if you dont. My car throws a p0741 code when overfilled and i take it on the highway... starts bucking. Take some fluid out and the issue goes away. If you are not going fast enough for the torque converter to lock up then you may not experience any issue.

To make you feel better, I had my transmission replaced with a rebuilt one at a shop and they overfilled my transmission about 3 fingers above the dot also.
I drove it for around 700 km and then went to their shop to question them about things, and brought up how my ATF level was too high.
They brushed me off and told me it's okay to be high and " Don't worry, Honda manual says it will overheat the transmission but it won't, guaranteed" or something along the lines of that.
Needless to say, I didn't think it would hurt to drain some ATF fluid, so that's what I did. I ended up draining like a quart or something out just to get it very slightly above the (upper) dot
I didn't have any leaks or anything for the 2 weeks I drove with it overfilled.
