I am glad you are o.k. Screw the car. You'll be in something better.

I hate driving this time of year. Too many people on the road with the minds elsewhere or driving tipsy.... Thank God for another 6 weeks are we are done for 2011.

The car can be replaced. Since you went to the hospital, your next step should be to consult a lawyer - now. Do not have any discussions with insurance companies before you've "lawyered up."

Glad to hear that you are alive. Indeed the car can be replaced. As hard a pill as it is to swallow, its good when the car is fucked up and we are not, means the car did its job. Hope you are back on the road soon!

Damn man... glad you're okay. According to statistics, thanksgiving is number 1 for the most dangerous holiday for motorists. It's got to be the food and wine and weekend drivers that cause so many accidents. I almost got into one myself today, a prius decided to suddenly turn out from a stop in front of me, almost could have t-boned that guy. Happy thanksgiving guys, and have a safe trip where ever you all are going.

That sucks but you're OK and that's what counts. Looks like a total to me. Frigg'n Camry drivers. They're just one step above the bottom dwelling Prius driver.

Feck me running!

The crumple zones did their job, thank God. It looks hurt, bad, I think I can see where the PS rear door was shifted into the rear quarter panel.

This local story happened Wednesday, 16 yo running from police @ 3AM, broadsided & killed a 22 yo kid in the military, home for Thanksgiving.

It can always be worse, glad to know you're ok.

Thanks everyone. I don't think there's any way they won't total it. All my airbags deployed. Both my front wheels are turned the opposite directions. There's probably frame damage from the left front side going to the right and back. If they don't total it, oh man I don't know what to do.

In any case, I'm not sure what to do now...I need to get the case number from the police but they're not answering right now...the tow yard is closed till Monday. I still have stuff to get from my trunk and glove/middle compartments. Does anyone know what happens to all the extra stuff you had on the car...like upgraded wheels, window visors, etc? Would I be able to take those off the car after the insurance is done examining it? Also, do I even want those wheels back? Pretty sure the front two might be bent and if not bent they'd be messed up. I can't really tell from the pictures. Any info on how to approach this whole situation is appreciated. I haven't known anyone who's gotten into an accident of this magnitude so I really have no one to ask except my azine bros. PMs are welcome or you can post here...

Also, what happens in the event that the guy's insurance doesn't have enough coverage to cover the value of the car? Do I just get the maximum allowed by his insurance and sue for the rest?

Depends on your State and insurance company. Here in Florida, if you remove items like wheels, you're supposed to replace it with the originals, some adjusters will tell you they don't care what wheels you put back on it. I wouldn't push the issue with the ventvisors...kinda petty, you know?

If you owe more on your car than what it's worth, and you didn't have GAP (Guaranteed Asset Protection) coverage, you're responsible for the difference.

If you don't have uninsured or under insured motorist coverage, then you have to decide if the guy has assets or if your best bet is to go after his insurance. Even if you get a judgement in a lawsuit against him personally, it's not likely you'll ever actually get anything out of him.

You need to see what the insurance offers you, look at all your numbers, then retain an attorney if what is offered doesn't make you "whole". Insurance is not a windfall, it's to restore you to the position you were prior to the accident, that's it.

Don't sign *anything* and don't give the insurance company a recorded statement before seeking counsel.

Thanks for the info HD. Will look into it.

My car is paid off already. I'm just afraid the guy has shitty insurance. I have full coverage so yea...I'm okay. Just trying to be prepared for any and all cases of what could end up happening. So I should get an attorney no matter what? Anyone know any in NYC that they could recommend?

Glad you're OK, man. Those pics made me cringe. I was in an accident on Thanksgiving 2 years ago, though not nearly as bad, I know the feeling.

One word - lawyer.

It is very simple. If you don't get a lawyer then you will get screwed.

While it is a known fact that 99% of lawyers give the others a bad name, in this case you really need a lawyer.Since you are injured you'll want one specializing in injury cases. Lay out all your questions during the free consult but focus on your health rather than your car. Your car is totalled so there is a new car in your future.

PMme if you want.

I agree with what HeavyDuty adviced! Also, you can make the claim with your insurance directly as oppose as with the other party insurance. Your insurance will work with you based on your coverage and then will go after the other party insurance assuming you're not at fault.
