The Details

We will meet at our normal meeting spot at 11AM We will kick it for a while if the rain isnt too bad at like starbucks or something, and shoot the breeze. If the bad weather is as persistent as jatt during a PW thread, than we will either head over to On the Border or Hooters.

I wouldn't feel right letting someone take the bike when they haven't paid for it.

I borrowed money to pay the Z off first. That way I would have any title issues.

You can mail the realease of liability, but isn't that on the pink slip?? The people buying it aren't going to able to register it or anything w/o the title.

yeah thats right too... He's going to make up bill of sale when I meet him, basically saying he's buying the bike from me as it is... that i'm going to fax him proof once I get the title and then he will mail me rest of the balance. After that I send him the title.... that's about it.

I mean he can't go anywhere, I'll have his info like CDL# address, etc.... and a deposit from him... I don't think this guy will screw me but if he does, I can repport the bike stolen?

my bike doesn't have any loan on it.... so if i give him the bike and he hasn't paid in full... i'm still responsible if he wrecks it? even if he has his own insurance?

It's still your bike until he has the title and has paid you in full (per the contracts terms)

He COULD say that he didn't understand the contract, and you're fucked


Just protect yourself. You don't want this to be a textbook case for first year law students in the future. (Most contracts cases are b/c the people were impatient or just poor contract writers)

the problem is that a common defense to contracts is fraud. He could go into court and say that he didn't understand what he was getting into, and then try and completely get out of the contract (an no, that other line won't help)
